Working Time Regs

Heard a rumour from a fellow driver that his union rep had told him that by this time next year the rules are changing regarding poa’s. He has been told it will be a 48 hour week average including poa’s. Have searched this site and Government ones but havent found anything to back this up.

Anyone heard about this?

I first heard this shortly after the WTD for mobile workers came into force, and at the time it said it would be changed by the next year. :wink: Think about it for a minute and you will see it would be a pointless change. Those who only want to do 48 hours don’t book POA at the moment anyway and those who do want to get more than 48 in would just book the time as break instead of POA. There is very little difference between break and POA, apart from the advance knowledge bit for POA which is unenforceable anyway. For this myth to be more credible it should say both break and POA are to be included in the 48. Including break time in the calculation would open a whole new can of worms as some companies don’t pay the driver for all breaks and some don’t pay for any of them.

It’s supposed to be 48 hours maximum and I understood that to include breaks but as usual, information about it is sketchy and we’ll no doubt be informed the night before it happens.

of course 48 hours should include delays waiting etc
my missus dont stay at work for an xtra 3 hours just cos the photo copyier packs in and it takes til going home time to fix

Yes but the point is we cannot opt out of the 48hour WTD, whereas previously other workers can.

I didn’t know the rest of Europe don’t have POA, they do have breaks though so POA going wouldn’t make much difference. POA or Break, virtually the same thing with a different name.
