Given that if you start a weekly rest in one week but it runs over to another you can attach it to either week - but no both, what is the law on holidays that span say four weeks (two days plus week A, two whole weeks plus four hours of week D)?
Example. A driver finishes work at 7pm on a Friday and starts a weekly rest. If he starts work at 0400 on the Monday he could ‘count’ his 57 hours off either in the week that ended on the Sunday or the week commencing at 0001 on the Monday.
What happens if the driver finishes work at 7pm on say Friday 31st has two weeks off and starts back at 0400 Monday 17th. Has he thus only had one weekly rest which happened to last for 393 hours or because the rest spans 4 actual weeks, two complete ones and two partial ones and because it is in excess of four weekly full rest periods (180 hours) he has in fact had four weekly rest periods rolled up into one?
I suspect it is only one weekly rest, albeit a very long one, but advice sought please. Thanks.
