The op has given no indication of what kind of work, for who, or what area. His previous posts tend to centre around class 2 tipper work in the North.
I’d say crack on then. This is where the agency don’t get to have their cake and eat it. You’re not an employee of the agency, you’re a company supplying sub contracting services to the agency so they can’t invoke the clause in their contract. If the agency ■■■■ and moan about it then say you must be an employee then so where’s your holiday pay and workplace pension contributions.
Nothing at all stopping your Ltd Co going direct with this company supplying driver services to them on a self employed basis.
