6hrs work - 15mins break - 4hrs work - 15mins break - 1hr work - 15mins break - 1hr work.

You worked 9 hours 45 minutes with only a 15 minute break.

Yes, if you are working over 9 hours then you needed to of had 45 mins before you hit 9 hours.

From my WTD reading this is legal.

None of your periods of work have exceeded 6 hours without at least a 15 min break.

Your shift was 12 hours 45 mins in total, so you needed to show 45 mins of breaks total, which you have.

Your shift began and ended with other work, and not break or POA.

You’re not telling us that you have done 12 hours work and not reached 4.5 hrs driving time !!

totalling 30 minutes. If more that 9 hours is worked then
breaks must total 45 minutes. Breaks must be of at least 15
minutes duration. Break requirements under the Regulations,

That’s only if his shift will be between 6 and 9 hours in total. It wasn’t. It was 12 hours 45 mins.

Seriously, the government need to rewrite GV262 as this is getting beyond a joke.

You cannot work a TOTAL of 6 to 9 hours AND a TOTAL of over 9 hours - it is either one or the other

Well lets break down what they’re saying shall we.

Cannot work for more than 6 hours without a break. He hasn’t.
A break should be at least 15 minutes long They were.
30 minute break if working between 6 and 9 hours IN TOTAL His total was 12 hours.
45 minute break if working more than 9 hours in total 12 hours total work with 45 mins total break = Job done.

over 6hours A break should be at
least 15 minutes long 30 minute break if working between 6

this dose not state that the breaks have to be taken in the 9 hour period just that a total of 30 mins need to be taken if working up to 9hrs and no more

45 minute break if working more than 9 hours in total
So by working MORE than 9 hours you need to have breaks amounting to 45min

Everday is a school day! Those regs are interpreted in so many different ways!

Ok ive learned something new BUT the tacho rules state that my second break is to be longer then my first as in a 15 min then a 30min(this clears driving time) so if a vosa officer pulls me and sees i’ve had 3 15 min breaks to satisfy WTD am i still legal?
