It does not say that non employees have a legal right, thats why i said they where broadly correct. Its does say that people who are working on the site have a right to the same Health Safety and welfare rights as any employees on site.
So in other words it is open to interpretation and not set in stone which is why certain companies are refusing drivers the use of them… I wonder if there is owt in the human rights laws…
To be honest i think you’re deliberatly acting stupid for some strange reason. All the information the OP needs is in the guidance leaflet, it even cites the relevant legislation for him. You interpret what ever you like.

Have any of you been to iceland livingstone, they have a sign up saying the facility for toilets for drivers has been removed due to damage to the toilets. There is a big padlock on the door aswell. Spent 3 hours there the other day just had a ■■■■ down the side of the wagon in their yard.

why dont you write a nice polite letter to the company director & see what happens as he may not be aware of this

Anyway lads i am fed up being treated like a peice of ■■■■ over here i have been a hgv driver for over 18 years and nothing has changed so i am off to V.D.B in holland and i am looking forward to it

I was attempting to find a LAW that a driver could stick under the nose of any company which clearly stated that they had no legal right to refuse the use of their toilets when the driver was conducting business on their premises.

It comes under duty of care, if you put razor wire up around your premises and fail to put up signs and a thief cuts themselves you are liable, if someone trips over a step with no sign same thing. There is no specific written law regarding visitors, it will come under duty of care as previously posted a call to the HSE should put them right. This is basic stuff and any manager who creates these rules should know this, or if he doesn’t he should find out, but as drivers we all know that rarely is a manager promoted to this role on his or her merit.

tbh theres no need to worry about things abroad like going for a pee because most laybys/rest areas have at least a toilet unlike here where there is next to nothing. anyway big ■■■■ good luck with the job, mayby see you about if im lucky.

It is only legal for a coach driver to do that… not a truck driver. It is also a legal requirement for the said coach driver to phone the nearest police station and request a policeman to come and cover him with a cloak whilst he does so… and also that he must keep his right hand placed firmly on the vehicle at all times whilst doing so…

They have to let you use the toilets it comes under the health and safety at work act. If you can,t use their staff toilets they must provide alternative facilities.direct.gov.uk/en/Employment/ … DG_4016686
I contacted the HSE Northampton office on this and they stated that there is no legal requirement for a company to let non employees use any of their facilities !!
The HSE stated that there is legislation in force for company employees.

What the HSE have quoted to you is very broadly correct. What they have not told you is that an employer/or owner of premises where people are working has a duty of care to anyone working on their premises and providing toilet facilities is one of the dutys of care.
So what about us ladies? If they refused me the toilet and I had to ■■■■ up the nearside wheel would I be able to sue them for leaving me no option but to get my ■■■■ out in public? I’ve got no problems doing that if caught short but even hiding in bushed I’ve seen perverts with cameras taking pics and giggling how’s that going to go down in a depot?

but i have never had a prob when delivering to a place if there are no female toilets im normally show to the staff 1s often been asked if i want coffee and shown to there kitchen
It’s disgraceful, but Rob K does have a point, even maggots would turn their noses up at some of the toilets in driver only waiting rooms, I’m afraid it’s a minority spoiling for the majority, but in some way it’s understandable, faced with a similar situation I would politely ask to use the facilities, if refused then I would conform to the stereotype & do what I had to do, it adds fuel to their fire, but ■■■■ em
It happens the world over too, some of the toilets in Euro driver’s areas are filth too, especially in France & Spain, even in Canada, my first ever trip over here saw me doing multi drop with a load of quad bikes, I parked outside one for the night & when I went in the next morning, asked if I could have a wash etc, the bloke said they had no running water, I asked for the loo, again, no running water, so no loo, funny thing was there was a bloke in the yard with a pressure washer Now this was a caravan/motorhome/motorbike dealer, so I doubt they’d had drivers destroying their facilities in the past, but they still refused me, the end result involved an open window on a caravan, a carrier bag & a vengeful smirk from yours truly

Over last three weeks I was working for local multidrop company, and they have a toilet when I only dare to ■■■■ from distance, it’s so ■■■■■■■ dirty. And no lock in the doors, but anyway, you can’t lock it as there is no light, so if you want to see anything, you have to leave doors open.
Once I needed something bigger so asked girls in the office if they have any toilets there. They said “yes, we do, but drivers are not allowed to use it”. Their own drivers!
I and along with thousands of other drivers treat facilities with respect. It is a minority who spoil it.
This blanket ban and all lorry drivers are the same malarkey needs kicking into touch - ban the people responsible sign for a key etc I wouldn’t mind that.
