Vosa.... fine on break

I got fined last year for doing a wee. Not normally a problem but because I drank the drink during duty time relieving oneself of the offending liquid later is seen as other work. So now if I need a pee in the night I resart my break just to be on the safe side.

I too use this modus operandi ! However as I get older & my bladder gets weaker & my prostate enlarges, I now need to pee roughly 17.5 times per night. So I have to keep restarting my break. Yes I’ve been stuck in strensham services since march last year.

+1 honestly made me chuckle that! Hahaha :grimacing:

not that long ago we had a guy in who after a little while was told he was going to warrington which is no less than a 12 1/2 hour shift, realistically a 13 1/2+ and he argued that he can only do 13 hours due to his 1 hour drive in which counts as other work (his drive hom was accounted for too) and this guy was adamant that he cant do more than 13 hours. the manager wasnt going to win and eventually gave up and sent him home instead

i havent seen him since that day

Not sure how it all added up,but I know one of our planners told a night lad to come straight back to our yard and leave going into another depot to drop stuff off as the lad had done according to the planner done 21 hrs :open_mouth: :open_mouth: ,I’m assuming he included travelling to work and back in that, but not sure still how he got to 21 hrs,I know where the lad lives and its about a hour from the yard ,so 15 hrs and his 1 hr travelling comes to 16 hrs not 21 hrs,but there must of been something in it as normally planners just interested in getting job done not how many hours you’ve done,it maybe perfectly legal to do 21 hrs(assuming he’s telling us right) if your travelling to works included but its bloody stupid if you ask me,lads got a hour to travel home at end of shift after all those hours :open_mouth: ,easily fall asleep.

Noticed on twitter this morning that some bloke tweeted, drivers beware vosa are on the A14 and have just fined my mate 60quid for reading his delivery notes whilst on break. Now i can’t believe this and i told him it was rubbish. What’s all your opinions?

I know we just had our CPCand they did make a BIG point about not working whilst on break,if your doing any kind of work you must be on other work, which is a BIG change to in the past as I wouldn’t say they’d of encouraged you to do it,but they wouldn’t tell you not to,turn a blind eye.
Not sure what has caused the change in there attitude to it,but obviously something has

Also a little known fact but all those people at the Trucknet do last night will have to do a manual entry as sitting round moaning is considered as other work

Don’t generalise Luke - it’s only other work if they are moaning about work or work related topics
However, based on the same thinking, anyone who donated anything at the do should be able to reclaim the tax on the donated amounts  although drinks are only tax deductible if you buy a round - this is classed as corporate entertainment and your boss should contribute too

Corporate entertainment! That’s a good one, I’ll buy some drinks on ferry for my fellow drivers next time and put it in with my expenses

How did they know it was delivery notes unless (a) he told them, (b) they were using binoculars or (c) were sat along side him?

If it was a. he was daft
b. That’s illegal under RIPA
c. He would no longer be on a break if they were in the cab.

As said before on these forums in most cases it is how you treat them and i myself have got on well with most of them including the ones at risby as this is local to me but i know for a fact of a driver who had stopped for a break when risby was shut at the start of the said weighbridge and when he had had his drink and sandwich he walked round and wiped his back lights a vosa car was approuching to open weighbridge at the time saw him wipe his lights checked what mode he was on then done him.I will not name the vosa man but there is one the one who done this man trying to make a name for himself and all he is doing is causing a lot of bad feeling and getting every body against vosa even his fellow workers have not got a good word for him but the rest are fine just goes to show you always get one a**hole in all walks of life

Deserved all he got for taking his break there in the first place.

That would constitute a delivery. And as you well know I can’t book on yet. So stop messing about.

From assets.dft.gov.uk/publications/d … port.pdf:-

“A break is any period in which a driver may not carry out driving or any other work and which is used exclusively for recuperation”.

Is reading Delivery Notes recuperation?

As regards the fine:-

From ukmotorists.com/motoring/Enf … alties.asp

"5.10
Insufficient Break

If time has been exceeded by more than 15 minutes and offence is current - unless valid justification is given, ie genuine traffic congestion or emergency

£60 Fixed Penalty

Section 96(2) & (11)(a) of the Transport Act 1968 as modified by Art 4(2) of the Drivers Hours ((Passenger and Goods Vehicles) Modifications Order 1971, SO-4"

New Poster Alert :stuck_out_tongue:

Reading anything is not work, it doesn’t stipulate the material you can or cannot read. ■■■■■■■■■■■, ■■■■■■■■■■■ and Animal Husbandry. are all frowned upon in public but not mentioned in the RTA1968.

Besides we work to a European Directive not the Transport Act 1968

You can read a road map, spend 45 minutes talking to your mate about lorries, spend 30 minutes having a tug in the bunk, it is your time and if that is what it takes to recuperate, who am I or VOSA to argue.

30 minutes on a bunk tug…jeez you must be a ■■■ god ( I average 41 seconds)

It gets longer as you get older and your arm weakens. So don’t worry you’ll soon be able to last 2 mins like me.
But then it gets boring.

He is Lucky, few years back, Vosa stopped me from using my car to go to work they checked the mileage and I got fined 200 for every km I had drove that week, to and from work. stated I had to write on the back of a tacho as other work!! London to Hatfield outrageous

Express Pete:
30 minutes on a bunk tug…

takes me that long to get “interested” :frowning: its a age thing )…then i get bored and end up back here

Absolute bollox and rubbish.

I do however predict at least two pages of stuff bearing absolutely no relation whatsoever to the OP.

What numbers should I choose for this weekends lotto?

Sign the weathers got a bit better, out come the VOSA men.
Noticed Beattock was doing a roaring trade on Wednesday afternoon,Carlisle was too on Tuesday morning.
