You do know the police instruction only covers the fact you exceeded your 15 hours? From when you parked in Bilton Way you still need at least 9 uninterrupted hours off. Looking at the times of your post it was probably getting on for 22:30 when you parked so couldn’t start before about 07:30 today.
If you get stuck in an unforeseen traffic delay and go over your 15 hours by say 30 minutes the regulations allow you to continue to the first available parking. That derogation is for exceeding 15 hours, or 13 if you don’t have a reduced rest available, and for the fact your rest period will no longer fall within the 24-hour period. In that situation you still need a minimum 9 hours, you can’t use the delay and going beyond 15 hours to only take 8.5 hours rest.
Sounds like you’ve only had about a 7 hour rest period and that’s a big fine in the slim chance you are unlucky enough to be stopped.
The police instruction simply says you can’t park here, go over your 15 hours to get to another parking place to begin your rest period and it doesn’t say have less than the required rest period.
Instead of having the drama at Watling Street last night you could have pulled out, gone over your 15 to get to Bilton Way, done a written explanation stating you exceeded your hours due to parking being full and that would have cost you about 15 minutes later start today. As a one off VOSA or whatever they are called now wouldn’t even bother about that. Instead you’ve left yourself open to a large fine and you were never going to win the stand off.
There’s no excuse for reducing a reduced rest. You’ll probably do time for this. If it was me, I’d be destroying my card and burning the lorry out.
Think you did the best thing there buddy, apologise and move on when asked to move on. The internet is a dangerous thing when relied on by some of the barrack room lawyers on here and will have you locked up or summoned in a jiffy, especially the nonsense about theft. Rv Gosh is the standard test of dishonesty and along with hundreds of stated case laws you would be trussed up like a kipper in no time. There are plenty of Burglary, fraud sections that cover just what one poster suggests. Just stick with driving shall we, it’s much less hassle
Lol sounds like a plan. I’ve spoken to vosa today and he support what I did but confirm what someone on here said which was I should have compensated my rest I also emailed the truck stop and got this reply
Hi Lee,Â
My name is Donna and I am the manager of the cafe. I am sorry about the trouble you had last night, Â and that is certainly not how I do things. I am on holiday from work today but as soon as I get back tomorrow I will be speaking to my parking marshal to find out what went on.Â
Please bear with me, and I will get back to you as soon as I canÂ
Kind regardsÂ
DonnaÂ

I phoned them up on the way and they said there was space.
I’ll just say this throws a different light on to, to me anyway. I’d be pretty miffed after ringing up and then getting there and finding out no room.

What■■? I was advised they don’t reserve places when I called up. What do you mean never turned up. Haven’t you read the comments
What a load of drama over parking up, the regulations that you have to abide by are of no interest to anyone who does not drive! Some seem to think it gives them a special status.
If you are pushing it you need a plan a,b and c and none of them include quoting tacho regs to someone that has told to %off.
As for getting them to call the bill, what a waste of there time and effort.

Agree
if you rang up first they should of given you parking,i’d say that’s breach of contract, allbeit verbal.

As I am new to all this and hoping to be on the road by the end of January.
I just wanted to ask is over night parking a major issue in the UK?
Are there certain Counties / Areas that are easier to find parking in and some harder?
Do the guys who drive in Europe have such a difficult time finding suitable overnight parking?
Are there major safety issues in certain areas?
Has an influx of foreign trucks had a major effect on the situation?
Sorry if I’m asking a stupid question, I just never realised overnight parking was in such short supply, and also wanna know what I may potentially be letting myself in for.

Nonsense. What if you ring a shop and ask if they have a particular item in stock and they say yes or your local sports team to ask if they have tickets available for Saturday’s game. You don’t ask them to reserve it or put it aside for you and pop down to get the item or tickets. In the time it takes you to get there others have been in and bought the item or tickets and by the time you arrive they are sold out. Are they obliged to supply you with something they no longer have? Of course they aren’t, you’ve no more got a verbal contract with the sports club or shop than he had with the truck stop.

The main issue for many is finding parking when you start looking for it with minutes to go.
Wouldn’t surprise me if they had promised that space to some other truck and wanted to make sure it was available when it arrived.Seen it happen before.I was told that I couldnt park in the exact same place one night last year.I hadn’t much time left and asked if it was possible to stay please.NO was answer.I walked to the truck and as I passed the trailer i noticed that one wheel had a massive bolt stuck in it.I went and pointed it out to the chap on duty and said there was no chance of me moving till I got it replaced.By the time the repair guy came out and changed it I was well over and going no where for the night only bed.I actually spun the truck around to make it easy for the tyre man and as I did the tyre blew. But to my surprise two other trucks came in after me and parked with no hassle.NO SPACE■■?. At first when he looked at tyre with bolt he suggested I move .I told him no way.I was lucky to stick to where I was.I would have caused havoc on A5 just before m1 junction at a busy time of evening. And be 3 hours over when eventually ready to go.
