I`m on via ADR, who sub to my customer, if I go direct to ESL, “prehaps” the rate will be even better and the work even more plentiful.
The ESL drivers dont hang around long enough to ask, and the agency "usual suspects" who are always in there, dont look like they would know too much on any subject…

Decided i should quit while the going was good!!!
I remembered then some of the other things Tosscos done to us on agency at Middlewich If you done say a nine hour day they would insist you went back out for another run. Also if you where booked for say 1pm start. Turn up at say, 12.50 (and i’d travelled from Liverpool), they’d say your start time has been changed to 14.30pm, sorry if you wheren’t told but thats it, you can wait but you will not be paid until then, they started to do this regular. I used to just go home!! I think it cost me money in the end. Then they left a mate of mine in Lymm services with no night out gear and would not pick him up. They stink biggo !!
Be careful with the idea that Tesco will pay redundancy as if the drivers are offered under TUPE the same jobs at ESL,s then you are not redundant and hopefully Tesco will honour the agreement to pay redundancy to those who don,t sign over.
If you do sign over and don,t like the conditions at ESL,s you have no redundancy to come as you have terminated your contract with Tescos.
Judging by the way they are treating their drivers would they think about reneging on the redundancy agreement?
Also TUPE only stays in force for a period of 1 year after the transfer then it is up for renegotiation of terms and conditions and that is when you might have problems keeping the same terms and conditions you left Tesco with.
Sorry NEJ but your post is wrong on every point you make,
1, Tesco drivers are being TUPE`d over from Tesco to ESL on the same T&Cs that is the law,
2 , Tesco drivers at Middlewich are all making the change (except some that are transffering to Lichfield DC )
3, ESL have to give 90 days notice of any major T&C change , then if The drivers dont agree with changes a redundancy situation occurs
4, TUPE law has no time limit , there is no lapse or renegotiation after 1 year.
5, After the TUPE changeover Middlewich drivers will not be Tesco employees anymore so Tesco will not be paying any redundancy payments that will be down to ESL, but under our old Tesco T&Cs.

Obviously the regs have changed (at least for the better) as when I was made redundant a few years ago that was the law as we were told by the legal dept. at the union that TUPE & same T&C,s only lasted for 1 year.
You are right on transfer of T&C,s with TUPE as that was law then as I said but then it was only for 1 year and then it was up to the union to renegotiate the T&C,s but as we were told then the new co. could give 90 days notice of new T&C,s but they couldn,t reduce your wages / salary without going to ACAS and having a valid reason such as to keep the co. financially viable which in the case of ESL wouldn,t happen.
Tescos stores now have a new uniform. And, they’ve all been given new name badges. On the badge it would say for example…Mike-C started at Tescos 2002. I wonder if the drivers badges will say …Joe Bloggs…started at Tescos 1990, sacked and taked on by Stobarts 2008!!!

TUPE does stay in force for as long as you work for ESL,we have drivers at our depot on days and nights who are still on Wincanton wages and conditions and that is after nearly 4 years of re-taking the contract over.
Stanley,the reason we don’t stay still long enough to chat at Lichfield is that its very uncomfortable sitting in the transport office and having the evil stares and gossiping directed at you,me i’d sooner be backup the road or up the canteen than listening to the drivers going on.Mind you saying that,i tipped at Coventry a few weeks back and i had a Hinckley driver give me hand to tip and he was a really good bloke,had a right laugh with him whilst i was parked outside a Lichfield driver tried to back into me and my truck outside the gate!
Me,i don’t mind doing the odd store delivery as it makes a change to tramping around the country,plus being able to park in the depots overnight and being able to get a good shower and meal is absolutely brilliant.
You are wrong Jase, No driver at Middlewich has taken redundancy, the reason for this is no redundancys were offered just a straight forward transfer to ESL or F*** off from Tesco.
some drivers have transfered to Lichfield and a handfull have moved on to new jobs elswhere, now the rest of us are just waiting for 90 days notice from Stobarts then take the money are we are off!!!
Why would ESL give you 90 days notice if they want you to work for them?
I don,t see how you can be “Redundant” when your jobs are still there as if they are not changing your T & C,s you are unless they (ESL) offer redundancy still employed by ESL.
Under the rules of TUPE (unles they have been changed) your job is still there albeit under a different name / company but the same T & C,s. so I can,t see where the redundancy issue arises unless they are giving you the chance to try ESL out as an employer and if you don,t like it you can walk away with the package and the money intact a good deal if that is what is on offer.
As when Morrison closed Warrington RDC 2 years ago any staff who signed over had a 3 month “probationary” period to decide whether to stay or go and keep the redundancy package if they chose to leave up to the 3 months.
NEJ i think he’s saying they are waiting for Stobarts to say their 37.5 hour week contract is going and they have to do as the others do, thats when they’ll be off?
ESL have already told us that they propose to change the roles of the Middlewich drivers to bring them more into line with the rest of the ESL drivers,
ie tramping, longer non annualised hours, reduction in hourly rate etc, ( how tramping will work in a dedicated supermarket distribution set up i dont know, but hey maybe ESL do■■?)
So if changes are proposed along these lines , that is a change to our present terms and conditions and ESL are obliged under TUPE and have already indicated to us that a 90 day redundancy process will be started probably after easter.
So yes ESL do require drivers at Middlewich but are not prepared to put up with our favourable T&Cs , so the vast majority will take the money and leave rather than agree to the new ESL T&Cs…
All I can say is good on yer mate and take everything you can get out of them as Safeway did the same thing to us before that git from over the hill took us over and shut the place.
The reason I mentioned the 90 day bit earlier was because management gave us the option of accepting new T&C,s before Morrison,s took us over and we voted 99% no to the offer and where told by the union and management that they could legally “implement” the new T&C,s with 90 days notice AND NO REDUNDANCY as our jobs where still there and to rub salt in the wound they said they would give us worse T&C,s than what was on offer.
Needless to say the “Re-Vote” was a “Yes” and after that it was all downhill from then on and as they say “The Rest is History”
Well the mood of every single driver at Middlewich is , hang on under TUPE rules, take everything we can get and then say [zb] you to Tesco and to ESL and then hope the whole lot goes ■■■■ up and Tesco`s immoral plan to save another few pennys backfires big style,
one thing is for sure ESL need us more than we need them

Not sure why you have highlighted employed by them, as further up the thread i state i was on agency for them, but lots over the years and i have worked from Crick (the old one), Hinkley and Middlewich and the frozen place at DIRFT.

Given the fact he has said they are all leaving, i think thats a foregone conclusion no matter how succesful the Tesco/ESL partnership is at Middlewich they are all going to be out of a job, well as far as working for ESL or Tescos is concerned.
I wonder what ESL will do with all those Axor units, can’t see many drivers wanting to go tramping in them, and how are ESL going to be able to deliver to Tesco Metro and express stores as well as some of the other bigger stores with questionable access in 6 leggers.
They are looking to get rid of Tesco in house drivers T+C’s to cut costs pure and simple.
Tesco have, at this quite time of year, reduced the guaranteed 8 hrs pay for agency to 6 hrs at Magor and we have to accept it or there is no work for us.
Can’t see them going back to 8 hrs now. What’s next, a reduced hourly rate down to 1 clubcard point per hour worked.
Some more Tescos cost cutting exercises…staff at RDC gate houses,no more. Its automated now. Reception at the stores has largely finished, staff no longer go through it and clock in, thay have to go through the customer entrance and through a goods in flap. Also and i have first hand experience of this (and kept the scans) when you turn up for a 19.00 booking at say 18.40 and they put you on a bay at 20.00 hours, they 'officially book you in as having arrived at 19.55. A major concern to me and the H&S i would imagine is that there is no one to give (or none available) Health and saftey requirements for the site upon arrival.
Boycott the ■■■■■■■■■■ Just buy the staples they sell cheap, bread, milk etc…(thier loss leaders)buy your stuff elswhere !! You can’t buy shirts for a fiver that have been imported without some poor ■■■■■■■ suffering along the line. Don;t help the ■■■■■■■ do it.!!!
