i never get stressed this way and unstressed drivers are safer drivers.

Hi Harry. Are you saying that if you are driving and no one else is in the truck at the time, then smoking is allowed period?

That is what I can gather from your above post.

No, you couldn’t smoke in (say) a Tesco lorry because you drive a different one every day. This only applies to those such as myself who have a dedicated vehicle. The link I gave includes the letter I wrote to Swale Borough Council and anybody in similar circumstances to my own can smoke.

You should bear in mind that your employer can impose his own prohibition on smoking in the cab.

The new law requires vehicles to be smoke-free at all times if they are used:
to transport members of the public
in the course of paid or voluntary work by more than one person — regardless of whether they are in the vehicle at the same time.
Vehicles that are used primarily for private purposes will not be required to be smoke-free.

The bit I have highlighted in red suports what Harry says.
When the law first came in i received a shedload of paperwork from the union and other bodies and all said “no smoking in a workplace includes any vehicle used for work” or words to that effect. That is also where I picked up the info re mechanics etc. So I am still uncertain.
Where I work i have a different vehicle everyday and so do all the other drivers so the ban is absolute for us but in fairness they have also banned anyone from smoking in ANY company vehicle which includes managers in co. cars etc.

I don’t know if I read it on this forum or somewhere else but there was a report of a painter and decorator being fined for smoking in his van, even though it was not (he claimed) his workplace but merely a vehicle for transporting his materials and tools. Didn’t hear wether his appeal was successful.

I smoke when I drive because it helps. I am reluctant to take on some work due to the so called smoking ban.

Lets say I took a container down to felix from brum and back and I smoked 20 ■■■■. Then ten mins before getting back I sprayed the cab with oust or something, then swept the floor, then wiped the dash and the window ledges would the next chap who is or could be a non smoker tell. More importantly could the manager/supervisor.

Even when I’m driving down the motorway, if someone in front is blowing their cigarette smoke out of the window as my patrol car travels through the smoke, I can smell it through the air vent!! :open_mouth:

if you have just had a few crafty ■■■■ in there with the windows open with a good flow of air through the cab they wont really smell it. stay cool and light up as you wish mate!!!

Unless you are “precious”, I think you might be exaggerating here.Doesn’t the smell of the diesel, ashphalt, petrol, rubber and hot steel tone it down a little for you?

In that case you should change your job…there are always vacancies for a good sense of smell at airportsand docks, generally dogs though!

That is the most rediculous statement I have heard on this forum yet. How on earth can anyone driving behind someone smoking, smell the smoke from another motorist. I take it we are on an Mway here doing 56mph

If I remember correctly, years ago there was people calling for smoking when driving to bad banned cos of hand off sterring wheel etc, but it was actually proven that it keeps smokers calm while driving and it was more dangerous to ban smoking while driving than to let smokers carring on cos stress levels where higher when not having a ■■■

Well Harry, I’ve been reading this thread with interest and may well get the chance to use your Councils interpretation and put it to the test :wink:

Just over 4 weeks ago I was delivering to Elmdon Trading estate at Birmingham and as I was leaving I was pulled into one of the NEC car parks for a multi vehicle agency check.

Licence/O licence/ vehicle plates etc checked first and OK
Unit and trailer mechanically checked and OK
Deisel tank dipped and OK
Digital Tacho checked and OK ( Pheeew) :wink:

Just as I was about to leave I was told that 2 young ladies wanted a word with me.

They were wearing High Viz coats with Public Health on the front, and told me I had been photographed on entering the checkpoint ‘smoking in the work place’ and I would be receiving a fixed penalty fine of £30.

I argued that in the evening the workplace was my lounge and at night my bedroom for 5 days a week. I argued I was the only driver.

They said that someone may drive it if I’m on holiday or off sick. I told them it didn’t happen (so, I lied :wink: ) and their reply was

‘’ But when that vehicle is sold after 3 years someone else will buy it and they will have to sit in it’’ :unamused: :unamused: :unamused:

What annoys me is that these two ‘young ladies’ are employed by the local Council, and their wages are paid via our Council Tax.
It’s also an interesting fact that the campaigners for this stupid law to be brought in, ie: The Anti Smoking Brigade, are also having their Council Tax used to enforce it :smiley:

Four weeks later and I have not yet had my fixed penalty notice arrive and can’t fight it until I do, but will certainly bear your result in mind, Harry.

This sort of PC, “any cost so long as we get a conviction” attitude is infinitely more poisonous than 40 Park Drive a day.
