Within that period no driving limits were exceeded and seperate 45 minute breaks were taken where required so no issues there in adition, to the breaks required for driving an extra 1 . 5 hours break time was taken and a split daily rest of three hours was taken between 1800 and 2100.
There was total of 72 hours rest time following the period above
but the 0045 finish time was then followed by 72 hours rest
if you know what imean
Makes no difference. The maximum spreadover allowed is 15 hours, not 18 as in your case. A split shift spread over is still 15 hours from start to finish, not fifteen hours, plus the three hours spent on rest.
I presume we’re talking about single manning here?
If you do a split shift then you should have a total of 12 hours daily rest in any 24 hours, the 12 hour rest period can be taken in two periods, the first period must be at least 3 hours, and the second at least 9 hours, therefore the maximum work time allowed is 12 hours in a 24 hour period, less any required breaks.
As your split daily rest was only 9 hours in total it was 3 hours short of the required 12 hours so it was not legal.
