The reason he’s done 99 in a fortnight is simple. In France up to 99 hours the fine iirc is 300 euros. As for 3 reduced rest periods in a week, the poor ■■■■■■■ was probably made to pull of a loading bay, ship, whatever thus cocking up his rest period…

Also the lorry is from Murcia and is in the uk on the 29 December.

Sure he worked all over crimbo moving fruit up. At prices better than the rest of the year.

Here’s the thing, drivers’ hours rules are totally illogical. If he drove for 56 hours in Week 1, he could only legally drive for 34 hours in Week 2. But if he went over this limit while a couple of hours into his shift on the Thursday of the second week, would his driving suddenly deteriorate to the point where he was a danger on the roads?

Im not saying the driver shouldnt have had some sort of ‘punishment’ (for want of a better word) but in this case imho the fine imposed is disproportionate to the misdemeanor. A warning would have been fairer…

On the other foot. For example a friend of mine was fined 1400e by the redcaps for not being able to do a print out (he had no till roll). We were fined 2000e for no covering letter explaining why my second man ended his card in England but started again in Gibraltar. It’s obvious to most that he’d been flown down (including us showing the Gaurdia the luggage tags) but they still parked us in a service area, locked the steering wheel up and left us there until the company paid.

Alternatively, I’ve talked my way out of stuff too.

I’m glad of the new tech that can download cards in situ and hang some of these firms who are pressurising every last second off a driver… Yes i know it’s down to the driver ,But some of these firms are verging on bullying the life out of drivers just to get stock shifted .
I think that fines woefully steep .

Would it matter given that they aren’t governed by EU Drivers Hours?

Never being one to side with the filth where are these heroes when curtains are being slashed and tanks emptied on their patch? Back at the nick stuffing themselves is the answer! No time for them at all. Of course in this instance the guilty EE may have failed the attitude test we just don’t know. The only ones I’ve got any respect for are the Germans, very sound and sensible.

But you are right. Soft target policing is what this is, nobody on this forum knows exactly every minute detail of this situation, but for me, on the face of it. Our driver wasnt taking the ■■■■. Admittedly a bit cheeky but over his spread it amounts to 10 mins here or 15 mins there. Hardly the crime of the century in Christmas week FFS, anyone think this chap WANTS to be in his situation rather than be with his family?

But the incident occurred on 9th December. What makes you think the lorry was still here almost three weeks later?

The entirety of the EU work to the same rules and the limits on hours have been almost unchanged for quarter of a century. If they can’t plan their jobs without having drivers run bent to manage to do it by now then the company should be shut down because they’re clearly too incompetent to run a fleet.

Depends on when you start counting them 13 days, if you started on a Wednesday for example, you would be covering 3 weeks in them 13 days. E.g. week 1, 36 hours week 2, 54 hours week 3, 36 hours. Not sure how you’d work that into the working time though.
