On a side note,would a cop have the discretion to say ,“okay,youve done wrong,Im parking you up,no need for further action?”,or is it just jobsworthism?
On a side note,I see one of the responses to the tweet was from some clown (a driver)in Chesterfield,who reckons once Brexit is complete,all this will go away!

And IF you broke the speed limit by say 1 mph,(and were caught),would you be happy with a fine and points,or maybe try your case with the plod?
My point would be,that when I was doing cross channel work,I was caught at Holyhead,over my spread.However for the full days work I had done some groupage collections,and driven from the general Avonmouth area,to Holyhead.Maybe 5-6 hrs driving max.Ministry man looked at cards,and I pleaded my case,it wasn`t exactly one hit from Rome.
I was allowed proceed.
Sometimes common sense breaks out.

You wont get flashed or stopped for 1mph though.
The same as we get given 200kg per axle leeway, 1% on height.
Not sure on the official stats for speed though.
Common sense/ not failing the attitude test also makes a difference. They are also only human.

if the companies in western europe can get away with paying flipflops the wages that they would normally get if they lived and worked at home even though they are working in sweden,holland,belgium etc,IE 250 euro per month.
then by the same rule,is there an argument to only be fined corresponding to the wages they can earn.
im not saying they should be allowed to be exempt from hours or fines,but if ikea/volvo can sub to companies in europe paying drivers a cpl hundred quid a month,then their fines that they have to pay should reflect their income n the same way you get means tested in the uk when your up in court and awaiting the penalty.
mr parked up jakobski is now having to pay approximately 4 months wages for doing a bit of overtime whereas if i got caught ( perish the thought ) its just over 1 weeks wages for the same offence.

its ok though if your caught for something in eastern europe for us though.

Of course. But let’s face it I suspect that not one person can say they’ve never broken any rules whether by accident or on purpose.I’d like to say I’ve never broken the rules, but I can’t. But there’s a difference between running an extra few minutes because you’ve fluffed your timings or want to get home and running up a bank of infringements.
I do think DD has a point reference proportionate punishment according to wages and let’s face it recent broadcasts have highlighted the pay and conditions these guys are working in.
Not really. Maybe I should smuggle drugs into the Philippines and just get a slap on the wrist instead of the death penalty because that’s what I’d get in the UK. This guy knew the risk, took a gamble and lost.
So yeah obviously they shouldn’t flout the law and of course it does seem like a high proportion of those caught are EE drivers, but to lose four months wages effectively would ■■■■■■■ the majority of folks
Fair point, I don’t like to see anybody suffer either. But thinking back a few weeks to those lads who ended up in court for similar offences. They received suspended prison sentences and received very little, if any, sympathy from people on here.
I take the point that we don’t know how much the 4th reduced rest was out, someone said it may just be five minutes, yet it could have been an hour or more. Considering the constant complaints on this board about the amount of time us drivers spend working, I’m surprised that people are defending someone who flours the limits that imposed for our protection.

I was at a wife swap party the other night. The rules were: whoevers car keys you pull out, you get thirty minutes in the bedroom with them. Well, I pulled out the keys to this right munter who only goes to these things for a jump. Needless to say, I threw the keys in and tried again, pulling out the keys to this absolute stunner. I demanded at least an hour with her.
Needless to say I was asked to leave and told that if I wasn’t going to play by the rules, I wouldn’t be allowed to play. Without rules, there’s chaos.

The rules are there for Health and Safety reasons as well as trying to ensure a level playing field for operators. I thought you’d have appreciated that. We’ll all set our own limits then , will that work for you?

Based on the facts presented massive +1 to this as diffinitive.
Yes we all want to be the right side of the law but ■■■■ happens and although the DVSA are the enemy (sometimes through no fault of our own) we should at least expect them to be reasonable.
Don’t get me wrong if pulled I will bow and scrape as good as anyone and defo pass the ‘attitude test’ but in return I would expect them not to act like hysterical women.
Course there is a little voice in my head that’s screaming the driver could have got away with a vastly reduced fine if he had wrote some bollox on a printout.
Maybe there is more to this than meets the eye.
Remember lads a printout is your best friend at times…
Here’s the thing, drivers’ hours rules are totally illogical. If he drove for 56 hours in Week 1, he could only legally drive for 34 hours in Week 2. But if he went over this limit while a couple of hours into his shift on the Thursday of the second week, would his driving suddenly deteriorate to the point where he was a danger on the roads?
