Weekly Rest over a staggered week

Another question.
I’ve asked several people and it seems open to interpretation.
The internet concentrates on 6 days consecutive work from the start of the working week.

So…
Working for an agency but 99% for one customer.
How do I calculate the start of my working week when I work random days including weekends?

It’s straight forward if I get 2+ days off together but if I’m working every other day e.g

T - in
W - off
T- off
F - in
Sa - off
Su -in
M-in
T-in
W - off
T- in
Sa - in
Su - off
Then maybe 4 days off

And so on. HTF do I determine where the start and end of my weeks are and what counts as reduced rest?

Then maybe 4 days off REGULAR WEEKLY REST and as it includes sunday midnight that can count as two regular weekly rests - one for week ending and one for week starting

You can start a fresh 6 day period from the last day you had off so you can treat every day off as a weekly rest.

However you have to make sure you have at least one 45hr rest in any two fixed calendar weeks. So if in the first calendar week you have a full weekly rest then as long as you take a full 45hr weekly rest at some point in the next but one week after that you’re golden. It doesn’t even need to be 14 days after the last 45hr weekly rest. You could for example have Mon, Tue off in week 1 and then Sat, Sun off in Week 3.

Keeping track of when you take your 45hrs off is the most important. You need to be having one at some point in every other week and making sure you don’t do more than 6 shifts between days off. When you’re doing only a few days between days off and having a reduced weekly rest you can treat on of those odd days off as a 9hr reduced daily rest and the remaining hours as compensating for the reduction on the weekly rest.

85 hours can be split

Reduced needed for the week ending so lets use 40 with 5 to be paid back
Then use 45 for regular weekly rest for the week starting

you will need a regular weekly rest to be started before sunday midnight at the end of this week

I find it much easier to tap my hours in a spreadsheet so I can visualise what I’ve done. Then it’s simple to see what rest you’ve had and where.

No repercussions so far.

If there were an infringement would it show on the tacho head?

You are fine, but you should know yourself. Once you’ve got an infringement it’s too late to correct it. The tacho will only show if you are approaching, or in the middle of an infringement. Once you have 45 hrs off (or maybe 24) it will clear and not be able to tell you about your infringement.
