Who owns the private road?

Haven’t figured that out yet. The only indication that it is private is from the signs warning of wheel clamping (my own assumption). The signs of course do have the clamping company name (CCS) and a mobile telephone number.

GET A SOLICTOR. This is obviously a case of unlawful arrest. The fact that the arresting officer and the custody sergeant had a row and you were then booked in under a different offence says that the custody sergeant was not prepared to accept you under the S47 offence as he considered the arrest unlawful. They couldn’t release you at that because that would have meant they were owning up to the incorrect arrest. BE VERY AWARE THAT WHEN THIS IS TRAWLED THROUGH THE ARRESTING OFFICERS NOTES WILL SHOW YOU WERE ARRESTED FOR THE PUBLIC ORDER OFFENCE. Yes I know its wrong but accept it, thats what will have happened.

Yes, this had already rung alarm bells in my head. I need to make a few phone calls, use some careful wording and see if I can find out what I was originally arrested with. Finding that out could make all the difference.

Get yourself a good solicitor and claim for unlawful arrest. There are several complaints for you to follow up here: unlawful arrest and several breaches of the Police and Criminal Evidence Act (PACE) which lays down the procedures for the collection of evidence and the treatment of suspects.

Don’t know any “good” solicitors up this way, or in fact any solicitors at all. I’m very wary of these no win no fee companies and the radio and telly advertisers. I would appreciate any recommendations for anyone local round W Yorks or perhaps maybe one of you have used one of the nationwide companies advertised with satisfaction ?

I intend to pay a solicitor a visit on Monday as I don’t start work until 5.30pm.

Apparently not. The security geezers who have been there a good while from what I understand, say that this is the first time it’s happened that they recall.

They know it’s happened. There’s no doubt about that. Brian was apologetic when I returned from the cop shop but that was about it. Of course the guys on the desk at Cas’ wanted to know what had happened and all they offered was “do you still want to do that run as we need you next week” :unamused:

As they tried to clamp you illegally what are the police going to do about that, are they going to prosecute the van driver for using his van as a battering ram or useing it to try to hold you and your vehicle captive.

Police have decided to take no further action. Full stop.

If this was a private road, who owns this road and do they realize that these clampers are behaving in an illegal way and the owners of the road could be held responsible for the clampers action?

To be honest, can’t see the owners being bothered. It doesn’t take a rocket scientist to work out that they’re just out for a quick buck.

Will your boss send a bill to the police & the clampers for the loss of earnings of the truck caused by their actions.

Unlikely, but that’s put the idea in my head now. Good thinking.

Is the Unit you were driving fitted with a tracking system? You should be able to prove that your engine was running, from details uploaded from the tracker system’s log. (I know ours provide this information, so assumedly yours will too)

From what I understand, they’re not. Good thinking though.

…by the way does landrover have cctv if they do you have the right to a copy of any tape that you appear on under the data protection act also they cannot charge you any more than £10 as this is the limit set by law for the copies.if they do you can bring a prosecution against :-

rob, my older brother currently serves as a police officer up here in scotland, i know the laws are slightly different down there in england but he served with the met police for 9 years. if you wish i can speak to him tomorrow 17th jan and ask him for his imput. he might be able to give you a course of action that you or your employer can take.please let me know. :wink:

the roads on the estate are owned by the people who own the indust estate,i have also seen them cart away belgium drivers and austrians for very small trivial matters (one had moved of boat at dover parked up and made up for movement then continued to landrover),they locked him up for 4 hrs bought him back but told him he couldnt go in for his tip,until he had had 9hrs break…landrover wont let you park in the premises,they do have a small parking place outside gate but keep m/t trailers there,so no one can park of the road…

Oddsodz, are you sure this is at DC1 ? Perhaps you’re confusing it with DC2 a bit further back towards the N.E.C. as I can see no parking place outside the gate which is no part of the “private” road in question. It’s neither here nor there anyway.

I’ll be getting onto a solicitor on Monday and will then hopefully have an armful of advice and a plan of action.

As I expected, the topic came up in conversation tonight down there in the canteen and there’s been numerous “they can’t do that because…” remarks being thrown around. One of them was that as this all happened on private land then surely it’s a civil matter and the police can’t do anything about it (ie. arrest) unless violence breaks out (which it didn’t) ?

Another comment made which was difficult to follow was something along the lines of if it’s a private road which has public access to be able to get to places in that area then the clampers don’t have any rights to do any clamping as in effect, it’s a public road. :question:

It’s all speculation at this point; I need to speak to someone who knows the laws of the land etc.

yep sorry mate dc2 but all the area around dc1/2 belongs in the end to the consortium who owns the NEC,how far back where you from the roundabout ?,i used to have this problem when i drove for carrs,if they couldnt tip on time i used to leave my phone number at gate then go and park up wait for them to ring,if they didnt after 2 hrs get the gate house to sign your paper work then go home.the place should be drop and go.not wait and wait,i have sat round at dc2 for 3 days!

I believe that if you make a Formal complaint they have to act on it. Reading your first post I presume that so far you have been the only person the police were concerned with, so they have not really looked at what the clampers were doing. must be worth persuing, if not civil action against the clampers is always a posibility so you should also discuss that with your lawyer when you see him on Monday… I would guess you would do well to seek a lawyer who specialises in transport related cases, must be adverts for them in some of the Truck mags. good luck anyway.[/b]

Boy, I bet you haven’t worked so hard in your life, answering all these messages. Must have sore fingers.

Be sure and update us Tuesday with result of solicitor visit and also Monday night’s run. Do you intend to pull into the yard if there is a gap?
It’s a good sign though if Land Rover turned you round quickly afterwards, maybe something will be done.

I know that not many of us buy Land Rovers each week but a good principle which I follow is; don’t patronise organisations that treat drivers badly. Thus I won’t shop at Lidl, Auchan, or Super U but will at Intermarche and Leclerc. I realise that to many of you these supermarket chains are unfamiliar but the last two will tip you on time and while you relax. The others don’t. I am sure you can all relate.

The whole incident was a total disgrace, why the hell didn’t all the other drivers stand with you and beat the [ZB] [ZB] out of the guys and make it worth being arrested.

In 1993 someone clamped my trailer in Swindon so I dropped it and went to pull out, the guy asked me why I was doing that and I said you keep the trailer, he unclamped it as it took up valuable clamping space.

I complained after I was arrested a few years back about my treatment. It was all over some delicate personal circumstances I’m hesitant to post here, but in the ned, they changed the rules so it won’t happen again.

Having seen a lot of your posts, I have always thought you are an argumentative little devil and I am sure you are quite abrasive … BUT that does not excuse the treatment you received on Friday night. Like a previous poster, I cannot believe that a load of other truckers stood and watched all this going on without interferring.
If I was you, mate, I would stand on the top of the tallest building and scream your head off over this one. Make sure some bugger pays for this!!! You are quick enough to cause an argument on this site lol so go get them, buster!!
I wish you all the best in your fight about this and hope someone’s head rolls!! Preferably those damned clampers!!
