“Near enough law” is not law.
The Police when prosecuting someone will never ever ever state “Under rule ■■■ of the Highway Code”. They quote either the Road Traffic Act or the Construction and Use regulations.
Until you can come back with the part of the Road Traffic Act that states it, you’ve proven nothing other than what is “best practice”.

The Highway Code is not law. The Highway Code is a book which serves as a guide for motorists about best practices for driving. It carries no weight in law, it cannot be used by either the prosecution or defence as an authoratitive document.
The ROAD TRAFFIC ACT is the law and you have yet to quote the Road Traffic Act.

I find myself doing it daily but I’m still in a van. (Stupid theory test, 3rd time lucky hey)
My vans limited to 62mph, however there’s always 1 who dawdles along in the middle lane at 55-60 mph whilst the left hand lane is clear for miles. I’m not risking pulling across 3 lanes avoiding loons bombing down at 70mph plus to pull back across 3 lanes.

With a speed limited van you would be illegal to use the outer lane of a motorway of more than 2 lanes - I am fairly certain of that but am open to being corrected

i watched one of those police programs recently where the traffic cop was following a chav in a clio and when the chav went to lane 1 on a dual carriageway to pass a slow car in lane 2 the cop said “oh yes…here we go…driving without due care and attention”

Referring to which car - if it was the one in lane 2 then they were correct in doing so
