Three or four years ago they used to pay up untaken holiday right before Christmas giving a nice little instant savings pot as back then I never really took holidays, I wish it was still the case so yes I’d sell holidays. Most years I only take 2 maybe 3 weeks and at the end of the year I have to use the holidays on weekends off so I don’t lose it. Although last year I took 6. I’m lucky, they let me take as much as I want and I’ve never been turned down a request for time of yet
Edit- ah so I see working your holidays and being paid twice was made illegal. I thought it was just the company being awkward.

Your statutory holiday counts as 48 hours per week towards your reference period WTR average so if you work elsewhere you need to watch your hours.
The additional days we ‘buy’ can be counted as 0 hour weeks to reduce our average because they’re not a legal requirement.

The law wasn’t directly passed to make that illegal. The law came in to give everyone a minimum amount of holidays. This was to stop those companies that gave very small holiday allowances. Places for instance would give 20 days but that would include the bank holidays, giving the employee just 12 days holiday a year. Some were less than that.
The 5.6 weeks thing is to give 4 weeks (20 days) minimum holiday to everyone who works a 5 day week plus the 8 bank holidays. Some places give their employees the full 28 days plus the bank holidays.
This isn’t a bad law, it was introduced to make sure everyone got a minimum amount and to stop companies giving poor holiday allowances or refusing to give the holidays and saying you’ll have to work them and we will pay you. Unfortunately the flip side to this means that with a legal minimum in place the companies cannot allow you to take less than that so working your holidays and getting paid is no longer an option, apart from days that are over and above that minimum.
It wasn’t brought in to stop people earning extra and unions were among those pushing for its introduction. It’s a far better law for the workers than the companies.
How on earth have the establishment managed to get so much power over so many parts of our lives?

I know, it has been done on a drip feed basis over the years. Conditions that our fathers and grandfathers fought for and stood up for are slowly eroding.
I certainly do not agree with militant style TU ism it does not work for anybody, but do believe in fairness.
The problem in our industry ( and I don’t honestly know why) is that unlike up to 20 yrs ago, very few drivers will stand up to authority and take any crap that is handed out, then moan to their mates about it. Bosses love this and jump on it, so things that would never go on once become the norm.
As for hols, in my case because of my last comments I am always wary of ANY new scheme that comes up…especially if I am told it will be ‘better for me’ because when they say that it means it ain’t!
I never even agreed with Bank hols being put in with your allocation to take when you want, as in a lot of cases some lads end up working them for single time.
So I always look for that hidden agenda and ulterior motive when these new management buzz word type ■■■■ comes up, that I would never agree to unless checked out by a bloody lawyer.
Somebody also said about the star artists that trade their hols in for truckcrap and shiny bars, I reckon the least said about those guys the better, another reason for reduced quality conditions.

Couldn’t agree more, I used to be a shop steward many years ago and packed it in because of the militant attitude which I believed was making things worse rather than better.
As for holidays I want more not less.
Years ago I didnt take any holidays at end of year got payed them all back
The company I work for now allow us to carry 2 days over or lose them this was because a few years ago 1 of the lads carried 10days over which for a small company was a problem so they stopped that & dropped it to 2 which is fine by me but we get 20 days as dont work the bank holidays
20 days statutory minimum holiday actually came in four decades ago. It was certainly in force in the 80’s when I started working. Statutory paid holidays actually came into force in the 1930s. It was then incorporated into the WTD and increased to 5.6 weeks pro-rata. You don’t have to take it if you don’t want to however you must be given the opportunity to and there is no requirement for a firm to compensate you for unpaid holidays or roll them over to the next year although some will. You can do other jobs whilst on holiday if you want as long as your contract permits it. Being on Holiday won’t reduce your average weekly hours as its classed as a 48hr working week for the purposes of the WTD so working it elsewhere won’t affect anything.

This year will be going away for 1st time since 2006 taking family up to Fort William for a week
I suppose I am doing that today. This is a rest day and I am on break just now. It is effectively the same thing since I don’t get holiday pay but it is a bank holiday. Same thing tomorrow since it is a bank holiday and I am starting at 0300
Now I’m confused . Can anyone work this one out then. Where I work we have a four day shift pattern based over any seven days . We get 20 days per year holiday . If we book a full week off they book us 48 hours if we book a single day off they only book us 8 hours – is that legal?
And here’s the other slice - out of the 20 days , any four days or a whole weeks worth of holiday they book us ZERO HOURS for , is that legal also?
