Yeah making him take a 45 seems incorrect, but anything i’ve seen on the subject says they (VOSA) are adopting an advisory approach when they come across breaches of the WTD.
I think the WTD is complicated in terms of prosecution directly because it really sets outs rights (to breaks) and conditions and the employer is supposed to monitor it. So as above, if non compliance is found its get onto the operator time.
