Pointy shoes keep their t’s and c’s…then.
On the contrary - the drivers will be keeping their T’s & C’s because of the protection afforded by TUPE. I think you’ll find it’s actually saying that the planners’ jobs will not be transferring, and they’ll be facing redundancy as their jobs will no longer exist…
Thought tupe only lasted a year?
And the way I read it was, that planning was staying"in house"
tmcassett:
I have no idea how long the TUPE process covers you for legally as far as your current terms and conditions are concerned but you can bet your life as soon as that period is up Eddie will be making changes to those - and not for the better!
All out old tupe drivers are still on the same terms when the contract was taken over and that’s donkeys years now since they were tuped over.
if you’re talking about Thorntons…i can assure you, that they are not.

To be fair, wasn’t it the case beforehand that the hourly rates for full timers at both Morrisons itself and Stobarts themselves - wasn’t that different? I.e. sub-£10ph?
…Interesting thing is, they are not advertising…
If they carry on like this, they will end up having to pay premiums to get block-booked agency cover in like Tescos - won’t they?
They won’t get that for sub £10ph in the South East of England like Sittingbourne is, I would have thought.
I dont know what the permanent full time drivers were on - I would have thought it was decent money but I stand to be corrected on that.
I do know that on agency when I did a few shifts for ADR back in early 2015 and early 2016 out of Burton Latimer it was £9.50 per hour PAYE and the shift times weren’t great, nor long.
Unfortunately they could get away with paying that as its “desirable” easy work so they had no shortage of drivers in there.
I went for a job there in 2015, only to find that the hourly rate at that time was £9.68ph, and you were expected to do permanent week-abouts 14:15 starts one week, 02:15 the off week…
I do wish they’d had explained the crappy hourly rate before I went for interview, as I wouldn’t even have bothered applying had I known.
I went in there via Firmins agency for £11ph nights just before I put my application in.
There was ADR putting Ltd drivers into there as well, but they lied to me that there was no PAYE available, just lots of Ltd shifts @ £14ph at that time.
I think there’s been a change since then that PAYE is now mandatory at agencies, and they can’t carry on this Umbrella/Ltd scam any longer.
I do wish these agencies would actually state their hourly rates on their websites, rather than “not tell you”, and then try to negotiate from a very low base once you get there for sign-up…
“Ongoing work @ local supermarket client, £9-£18ph Hundreds of shifts per week available”
Then when you turn up… “We told you over the phone that we’ve got lots of work, ongoingly. That’s true IF you’re working Monday-Friday 9-5 for £9ph” “That premium rate £15-£18ph we spoke of - is only available after you’ve worked 55 hours the same week at that venue, the £18ph rate being for Bank Holiday overtime in the same vein”.

Watch your T&C’s. They decimated Tesco drivers T&C’s when they took over

Must of been with the drivers approval though, t+c’s are protected under TUPE.
They made them all redundant then tried to not pay them redundancy. USDAW took them to court and won. Stobarts paid the bare minimum what was owed for redundancy then offered the drivers their old jobs back on the new contract. Sign it or no job
Winseer:
…With all this said about Stobarts, I’m surprised that people don’t totally boycott them, like so many seem to like to boycott agencies…
At least they won’t be phoning me day and night though.
Boycotting is a luxury afforded when work is plentiful and I’m not sure that is the case for the foreseeable. I do know the (ex) full timers at Latimer Park (incl the non driving team) are truly gutted at this. There was always a sense of pride working for Morrison’s which I doubt will be the case with Stobarts.

I think when others (DHL @ Tesco etc) have gone through similar outsourcing of transport, the planners have remained in house and the transport company follows their plan
I’ve been TUPEd twice over the years. In both cases (one of them involving DHL taking over, the other when DHL left) the office functions (including most of the planners) were not transferred across.
