It would have to be counted in one of the weeks and it was 10 hours driving between two daily rest periods. The same argument could be put forward for when you have a 9 hour daily rest Sunday/Monday, which I often do, that still counts as a 9 even though it was in two fixed weeks. If I have had three nines already in week one that one counts in the second week.

Fwiw, the gaffer of Featherstone’s isn’t getting my last two weeks worth of tacho’s of my employment there at all until he pays me what I’m due
