The decision to REDUCE DAILY REST (doing extra work isn’t the important part) lays firmly with the driver.
A planner can legitimately plan for a driver to reduce their rest, however it cannot be imposed on the driver.
Is there any my thing in black and white that states that

Probably depends on your contract but if you are knackered then stop. Your choice as a driver. Talk to your TM and tell him why. Safety over rides everything. Be sensible about it though. If it’s just the odd one here and there then you may have to accept it if you feel ok to drive. Do you have a good relationship/ work history with your company. If so they should accept your reasoning?

Boss: Sutto, I need you to do me a favour. Head to X and pick up this for me would you?
You: Thatll put me over 13 hrs. Not doing it
Boss: I need a favour. Youll be back before your 15 is up
You: Nope. Im not legally obliged to do 15 if I dont want to
Boss: ok
Two weeks later -
You: Boss, I need a favour. My child/wife/mother has an appoitment at 5 tonight so I need to be finished early
Boss: Remember when I asked YOU for a favour a fortnight ago…
A tad extreme maybe but the point is valid. Too many drivers want it to be a one way street and think anything less than telling the boss to stick it counts as bending over and being shafted.
It depends on why youre asking of course though. If its regularly expected of you and your planners are unbending in not giving you any favours then fair enough but if its a decent place where they accomodate you then you need to remember its a two way street.
I believe in come and go with employers and will do things I dont want to as long as I know it is up my sleeve and they will remember it.

It’s the wrong aspect of things however I work n drive in total of 80+hours a week and 4/5 nights out a week so trying to get anything from them is hard, I had to enforce it as I feel they don’t give a sh*t (yes it’s business) but they not taking care of the drivers which forces me into this predicament.

I think in 2018 the right to limit your working day to 13 hours is not unreasonable. 13 hour shift is plenty to give a firm. As for doing the Boss a favour it’s my experience that that favour soon gets forgotten when it’s time to collect.

For the sake of £12 per month you could have had Union legal advice. This is a lesson for all drivers… No matter if there is no union representation in your workplace get yourself into a union at lest for the free legal help in a dispute
I think it depends on how your contract is written. I think mine does say something about being flexible with times and hours, but doesn’t say you must be prepared to do 3 15 hour days and 2 13 hours in a 5 day week, but then if I was splitting hairs if I did one hour over my basic and started at whatever time they asked then I’ve been flexible, and done the hours I’m contracted to plus more…
But, as someone said. Favours work both ways. I know my company have always been accommodating with me when any personal issues came into play, or if I wanted to change shift patterns etc. If I’d been an awkward sod and splitting hairs over how my contract is actually worded I imagine they would have given me the middle finger when I asked for help from them.
The driver can state safety rules if they feel too tired to work long hours
What can happen is that the employer can dismiss the driver as not being fit for what they need
What the driver should be doing is making sure this sort of thing is put down in a written contract before starting the job

Legally, there is nothing to say who (driver, planner, TM, employer) makes the decision. It all rather depends on what your contract of employment says.
I hate this crap! I hate these children in traffic offices who expect you to be at work hours before they rock up and then still expect you to be working long after they’ve gone home! if you want to do a 15 then do a 15, if you want to cut your day short then cut it short. There aren’t many on here that are delivering blood or transplant organs therefore tomorrow is a whole new day not yet started!
We have one such spunktrumpet in our office who will without fail ask “what time did you start today?” And without fail my answer will be “you’re asking the wrong question, you should be asking what time I’ll be finishing today” I then ask him what time he’s finishing, to which he’ll reply “6” and so I say “yeah, that’ll do nicely, 6 it is then”
If an office bod demands that I reduce my break I always tell them to have 9 hours off and phone me from the office when they come back in, if they don’t phone me from the office after 9 off then I don’t have 9 off either.

No Union at my place, what Union could I join?
