Well, legally your old employer can’t give you a bad reference out of spite, but saying that he probably will.
I wouldn’t even mention him on an application.
i thought about that but i was there just over a year so trying to explain that much of a gap in work history makes you look lazy when i used to work maximums every week just about so its far from what i am if you get me
find a firm that went bust. use them for your reference.
put it in your cv that you worked there but put a note in it stating that you had a tribuinal case against them and fear any reference would not be a true reflection on your working ethic
just to play devils advocate…Wouldn’t putting down on a form that you took your last employer to a tribunal not make you look like a trouble causer? Do what LimeyPhil said IMO.

correct, but, they can refuse to give a reference, and that can be taken as bad
also, a company can tell the truth (backed up with evidence) which can be classed as bad for the employee
such as, a company can legally say that the employee’s timekeeping was poor, if they can back it up with evidence

If you won the case, what’s the problem? Personally, I believe total honesty would be the best solution, cos if you tell even a white lie and get found out you could end up with another dismissal, which could hardly be classed as ‘unfair’.
Don’t be honest. it won’t do you any good.
look at all the people in prison. they thought honesty was the best policy.
Always best to be honest and upfront.If you lie,you have to keep covering up,and an honest employer will always appreciate an honest prospective.Or am I completely out of touch?

Realistically it’s catch 22 because most,if not all,firms ask for at least three or more ‘checkable’ references so they’ve got that old dodge covered.The problem is it not only makes it bad for those in the OP’s type of situation but also those who’ve been working for a number of previous places where there’s no way of getting any references anyway for whatever reason.
This issue is one of the reasons why the employee’s future job prospects need to be taken into account when they weigh up the level of compensation which as things stand in no way reflects the true level of the difficulties caused by unfair or constructive dismissal etc.
The fact is asking for references should be banned.The only relevant questions allowed should be did the employee leave their previous employment by choice or was the employee sacked (fairly) by their previous empoyers all of which can be sorted at the application form stage.
Don’t be honest on this occasion.
Just tell them the truth, then add that if they don’t employ you that you’ll see them in court !!

Correct, which means they can legally give a ‘bad’ reference.
Personally I would tell the prospective new employer the truth, might not get you the job but if you lie it could come back and bite you on the ar$e.

If you came to me for a job and I knew you’d taken your last place to a tribrunal, you wouldn’t get a look in.
Doesn’t matter how good you are at your job, Tribrunal means trouble - avoid like the plague.

This is one of the reasons I didn’t take my former employers to court on a matter yep I would probably have won but the consequences at the time I thought were just to high risk
Yes it may feel god at the time but then you have to live with you actions
