Is there not some H&S law where it needs to be a certain minimum temperature for you to work in?
Technically if he’s on stand by he’s working, as he is being paid,.so I would reckon you’re maybe right.
I’m personally all for these regs that can be used for our benefit,.it’s a good stick to beat them with, …they are quick enough to use certain stupid regs against us when it suits them.

I’ve done standby work for Arla out of Leeds. First night sat on my arse reading the paper for 4 hours. Second night asked for the keys to a motor that had a night heater, fell asleep in that for 4 hours. The following week, I told the agency I would remain at home, if the phone rang, I’d go in and cover, if it didn’t, I get paid 8.

That’s the way to do it. Always used to do that for Royal mail on their flex shifts, but you’d get 12 hours pay if you stayed 8 hours
I remember one week sleeping 6 nights in the same unit and never turning a wheel for net of £1000+
