Hi All
I have a Driver who keeps smoking in the company vehicle even though I have told him not to, what action can I take to put this to a stop?, as I am not sure where I stand legally!!!
depends on how far you want to take it, and also what position you hold within the company
sack him, gross misconduct for disobeying a direct instruction, and the law, it is illegal to smoke in the workplace
written warning, same reasons as above
verbal warning, same again

although i dont smoke any more, the guys who drive my wagons have the choice to smoke if they want as no one else drives them apart from me occasionally, and I can live with it.
Its better than seeing them park up have a ■■■ and then crack on again.

I thought you were allowed to smoke if the vehicle is not used by anyone else? the drivers at our place all do, ■■■■■■ me off if they smoke in mine if I’m off and someone else uses it though, not the smell just bloody ash all over the place

Sensible post is sensible. It’s a pity more people don’t have that outlook.

In all seriousness, why do you consider it to be a problem that needs action taken?
Thing is, all you have to do is leave the window open a few inches when you’re smoking then leave both windows down for 5 minutes before you get back to base and no one would be any the wiser, is he also a bit thick?

Ahh i see, well thats different, i thought you ment about him smoking in his “own” lorry. I wouldn’t bother with the softly softly approach, firm but fair in this case, you’ve asked him once before. ACAS is your friend, they’ll tell you how to handle this from a legal point of view.
I am a non smoker but every one of the four agency guys I have done my run with recently is a smoker. The first time each one was with me they asked if we could stop for them to have a smoke, I said no.
They looked a bit peeved until I said just crack your window a bit and light up. I would rather that than keep stopping, which if they are driving is just going to wake me up.
Most of the time I don’t even notice when they light up.

I smoke in the truck,landrover and at work (in the garage) but not in the house or the car or in front of the kids!
if you cant work it out yourself i will give you a clue…DONT LET HIM DRIVE THAT [zb] CAR!!!

Agree 100% with this. All the drivers know the rules but I would sooner turn a blind eye and let the wheels turn than them stop every hour!
