Weekly rest

I’ve been told to day that you no longer have to compensate for 24 hour weekly rest .I’ve not heard this before

Where I work at we do straight 24 hr one week in the cab and about 55 hours the next weekend when I get home. I never get my 90 hours every fortnight unless I’m on holiday and I was stopped a few weeks back and had card and head done. Nothing said about it, I think it’s a bit of a grey area

Assuming that you’re talking about 90 hours weekly rest in a fortnight there’s no grey area at-all.

Nowhere in the regulations does it say that you must have 90 hours weekly rest in a fortnight, the regulations say that in any two weeks you must have either 2 regular weekly rest periods or 1 regular weekly rest period and at-least 1 reduced weekly rest period.

Having said that, if you’re having 55 hours weekly rest one week and 24 hours weekly rest the following week and doing this continually, I would have thought that you’d have to be quite lucky for your holidays to match when you need to pay back the compensation.

Must admit well explained tachograph, I know that the compensation is meant to be by the end of the third week but basically all the ones I work with never worry about the compensation, we just look at it as if you get 24 on the button one week and 45 the next then your good to go. I know ones has been doing this continually for years now and they’ve never been done for doing it that way

If you do 24 weekly rest hours in week 1 you’re 19 hours short of the 45, and need to compensate. If you do 55 weekly rest hours in week 2 you’re 10 hours over the 45. So knock that 10 hours off the 19 you owe, and you now owe 9 hours. So surely by the 3rd week you still need to compensate, and have 54 hours (45 + 9), don’t you?

I do not think they are because 45 + 45 = 90 and to pay back over a regular two week rota needs to total 90

that would be correct especially if your companies based this side of the water and running uk/ireland north south or cross channel work.
if your stopped and have 24/45/24/45 then your not going to get any grief from anyone.
no doubt there has to be a vosa plob somewhere that would disagree,but ive yet to meet one ( and ive met plenty).
never known anyone having a hard time for those breaks legal or otherwise.
