Why would it be an issue for them, it doesn’t contravene any part of the regulations. It’s the driver’s choice to do it or not.

It would be impossible to do a 13 hour duty while utilising the split rest. It has been pointed out many times that the duty time will be maxed out at around 12 or 12.30 hours as the two movements must be included inside the daily duty while still taking an actual 11 hours rest periodI have to correct you here, you could do a 13 hour duty every day and embark and disembark a ferry during your 11 hours off every night. This is what the Law says…
If your vehicle is being transported by ferry or train, the daily rest requirements are more flexible.
A regular daily rest period may be interrupted no more than twice by other activities not exceeding one hour in total. This allows you to drive the vehicle onto a ferry and off at the end of a sea crossing. If your rest period is interrupted in this way, the total accumulated rest period must still be 11 hours. You must have a bunk or couchette available during the rest period.
You do not have to add the periods of movement to your daily rest.
This bit is important. A regular daily rest is a minimum of 11 hours so if you work 13 then interrupt the period to board or disembark from a ferry, or both then you won’t fit 11 hours into the 24-hour period. You cannot interrupt a rest period of less than 11 hours, it’s been that way since 11th April 2007 when they did away with the adding 2 hours onto the rest thing and allowed 2 interruptions instead of 1.

Rest 19:00 - 23:00
Board ferry - 15 minutes.
Rest 23:15 - 03:30
Disembark ferry - 30 minutes
Rest 04:00 - 06:00
06:00 end of 24-hour period and only 10 hours 15 minutes rest taken = illegal.
You have to have at least 11 hours rest in total so you need to allow time for the interruption(s), which means you can realistically work 12 - 12.5 hours before using the interrupted rest option.

Nothing vague about it, all the normal requirements for daily rest still apply when making use of the option to interrupt it when using a ferry or train. So,

The rest must be completed within the 24-hour period which began when you resumed work after your last rest period.

When using the option to interrupt the rest period you must use a regular rest period, so minimum 11 hours in total.

Have less than a total of 11 hours, not legal.

11 hours not completed within the 24-hour period, not legal.

It would be better to say “The maximum time you can work is 15 hours, but only three times a week, and on the remaining days you can only work 13 hours”
Last week, I had 12 hours off on Monday night, and 13 hours off on Tuesday night, yet on Wednesday I had taken two reduced rests and had not had one 11 hour break. This is confusing for many and the law should be stated in as simple terms as possible.
Come on then mr bernie draw us out a typical schedule for these illegal runs with timings and breaks then we can see as from where I’m reading it looks legit

The whole point is that it it is legal according to tachograph law, yet it does not allow the employee to have sufficient sleep to carry out his duties safely.
