hi i just been pulled today by vosa at 545am this morning my tacos were ok my truck was ok ive sent my digi card off to DVLA friday cause dvla sent me a letter saying it was faulty so i sent it off Today vosa ave issued me with a 24 hour prohibition and clamped the truck with 80 pound release charge and 200 pound fine for not avin my digi card the DVLA are no help they told vosa that they ant got any record of sending me that letter now iam off the road till its sorted my truck is anoylog i dont need the digi till march when my new truck arrives Switch island is the only place were the police ave a different rule to vosa ave any of you had any problams there or got any advice please
Only advice is,
If sending in your digi card, always send it signed for 1st class.
Then you will have posting proof.

The action taken would indicate the driver had no evidence of correct weekly rest over at least a two weekly period. if operating an analogue vehicle and the digi card had not been used this would not be the case.
If the driver has received a £200 GFP it looks to me like the operator will also receive the same and a follow up enquiry.
Also - I believe the faulty digi cards were dealt with months ago and certainly don’t know of any cases of DVLA contacting drivers now. Any concessions VOSA may have made for the large batch of faulty cards expired many months ago.
This will undoubtedly cost the operator heavily on their OCRS score … but maybe they don’t mind.
If you haven’t got your card then have you got a printout with your manual entry on ?

Not necessarily. I still have the letter about mine being faulty from the middle of last year some time and still not sent it off yet due to not doing any driving work at the moment. I’m sure I won’t be the only one.
Digi cards can become faulty at anytime. There was the main calamaty when a lot of them failed last spring, but their have been a couple of other recent problems I’ve heard about with certain cards. Rob, what is stopping you sending it off and getting it sorted ?
As for the DVLA, for something that they, VOSA and the authorities hold in such high importance, you would think that they would get the digital tacho and the machines in the trucks spot on before rolling them out for use.

Haven’t had a faulty card/letter, but I think the “letter” says something about phoning DVLA and obtaining a reference number before sending the faulty card back to them.
thanks every one i sorted it today rang DVLA they said my digi be here friday and gave me a reff number was back on the road this aft ive appealed about the fine.
The police @ Switch Island are known to be very heavy handed and a law unto themselves regarding the levels of fines they issue. They accept no reasons for what caused an offence, they simply set a penalty. One of our drivers was fined £520 for 3 ‘insufficient breaks’ offences and the copper told him that “if you don’t accept the FPN I’ll come to your depot & check through 18 months worth of your tacho’s”!!!
Sounds like ‘blackmail’ to me.
We had VOSA out last week to do an operator audit and they told me that they can, and do give the benefit of the doubt to drivers on minor tacho offences but the police @ ‘Switch’ DON’T!!!

i was pulled into rivington services on the m61 a few weeks back by vosa
similar thing all tachos ok , lorry ok but had forgot my didgi card as dont use it cos all lorries still on analogue
wouldnt let me move on until my didgi card was shown , had to get daughter to bring it to them
once they checked it i was on my way
always carry it with me now
I also had a run in with the police there. Tried to politely make a point and the baldy one with the attitude and ego shouted ‘DON’T GO UP AGAINST ME, YOU’LL LOSE’. I thought it rude to to rise to this challenge so complained to Merseyside Police. He lied. About saying that and warning me about infringements, They didn’t and when they produced a sheet to say they had didn’t have much to say when I pointed out I hadn’t ever seen it or indeed signed it. I don’t trust them and record any conversations I have there on my phone now.

That list is out of 145,000 police officers in the UK so there “Not all know that”. What i am getting that, which a lot of people do on here, is people are getting tarred by one brush due to “One persons actions”, hence my reply to Robk.
Robk gets stopped in his little car doing 15mph in a 5mph zone and was given a ticket. Robk then tar’s the whole country with this opinions. This is what the country is coming to with it being filled with people that moan non stop, or give it large on a forum
Also that forum is used by people who want to get themselves out of debt by sending letters. Look them up on Youtube and you will see what i mean
