If the petrol tanker is simply ‘empty,’ then it remains fully subject to all ADR requirements, including the need for an ADR tanks licence.

If the tanker is empty AND cleaned and purged, then anybody with the correct driving licence can drive it.

I agree with your statement Dave, we always used the words “notionally empty” if the tank had not been cleaned and purged and up until then it must adhere to the ADR regs.
I was always taught (many years ago) that if I was stopped by any law enforcement officer with a notionally empty tank I must still have all the protective clothing in my cab locker that was stated on the hazchem card, otherwise I would be committing an offence.

Maybe you can answer another question for me.
If a driver who has all the necessary protective clothing to drive the tanker takes a spare driver to collect another vehicle (for example) is the spare driver committing an offence if he doesn’t also have the protective clothing with him needed for the product carried?

The old ‘Tremcards’ have now been replaced by a much easier system called “Instructions In Writing,” but the answer to your question remains the same…

For each crew member of a vehicle that’s subject to full ADR, including ‘notionally empty tanks,’ the following PPE is the absolute minimum:

  • a warning vest (e.g. as described in the EN 471 standard); [ = Hi-viz]
  • portable lighting apparatus; [ = a torch]
  • a pair of protective gloves; and
  • eye protection (e.g. protective goggles).

If the vehicle is carrying UN Classes 2.3 or 6.1 (including when 6.1 is a secondary or tertiary danger,) each member of the crew will ADDITIONALLY need:

  • an emergency escape mask [ = a respirator]

As far as i recall if they tanker is purged and clean and have a certificate to show that then it is adr exempt i believe

I was born on a dairy farm and the cows teats are washed off with paper towels and given a chemical wash before the vacumn clusters are attached,in a hurry,you can miss particles of cow muck and straw bits on the teats that go in to the bulk tank.
The cows muck boosted my immunity system to fight off colds and flus,as i would drink untreated milk,full of bugs.
The teats would be dipped in iodine solution after the clusters were taken off.
With a rise in Asthma,there is a link to having such a sterile household enviroment for kids,not saying that they should be drinking milk with cow muck in it,but i am still alive.

Dirt & bacteria are good, builds up the immune system. What doesnt kill you makes you stronger.

Sounds daft, but yes and no.

If your boss tells you that you can drive it and it’s not under ADR regs, that’s the end of your responsibility :wink:

But other than that, mostly no, assuming you mean a tanker and you’re not trying to play on words with IBC’s and under certain sizes etc, then no, petrol and diesel are both well into ADR regs in a tanker.

If you have a HGV licence which covers the type of tanker you want to drive then yes, you can drive it without an ADR cert, it would be illegal of course but you could drive it.
I also could drive one and I have not got a licence any more so I would also be driving illegally but yes I could drive it.

I proved it last week when I drove a friends 44 ton Scania around private land just to see if I could still drive and I could.

No you cannot leagally drive the tanker (assuming this isn’t a trick question, and you do mean on public property. Even if your boss tells you that you can you can’t (if he told you to take his sawn off and go make a withdrawal at you local Barclays it’d be you that ended up in a room with stripey windows, not him)

authority …

The key word here is the first word in the quote.

I’ve taken your question at face value and based my answer on the info you gave.
There are one or two little exemptions, but you haven’t mentioned anything that makes me think they might apply.

You could probably drive a fully loaded milk tanker without an ADR cert’ and be tacho exempt if you privately owned your own regional distribution centre and didn’t drive more than 50 yards on the public highway or when crossing a public highway to gain access to your private property.
