No, those company vehicles (including HGV) which are ONLY used by one person are not included in the legislation.

This is good to know. At least the legislators saw some amount of common sense in allowing smokers to go about their daily work, if in a cab on their own. Interesting looking at the comments on the forum how intolerant many of the non smokers are. Whether you are a smokers or not the idea of the original post was to see the mindsets of different people on the subject.

We aint intolerant of smokers, couldn’t care a toss what you do to yourself, so far smoking hasn’t been made illegal so you are entitled where allowed to do so and i hope that happy position remains the same for smokers.
However us non smokers are also entitled to smoke and smoker’s debris/film/stench free environment to work in.
By all means if you are the only one that uses your vehicle, including taking it to and from inspections and driving it to and from the annual MOT test, then yes so long as your boss agrees smoke away till the cows come home.
If the vehicle is used by others then no matter how your try to minimise how much the stench permeates every surface inside, at the end of the day your sense of smell is destroyed and you don’t have a clue, and appear selfishly to care less, just how bloody awful being in that vehicles will be for others who don’t smoke and still have a normal sense of smell.
Its also illegal and you leave yourself open to dismissal.

I think the above paragraph is a perfectly reasonable statement. You chose to reply with more vitriol and well that says more about you than I thankfully.
It is funny how you mention the idea of a non smoker having to take a vehicle to a test centre once a year. Heaven forbid he or she might be overcome by the smell of smoke and be irreparably traumatized. With it becoming an issue for a person having to drive a smokers truck once a year it really is in the realms of drama queens and divas as another poster mentioned earlier. That’s the world we live in today, lucky they weren’t around in 1945.

Mate of mine is an avid smoker, he’s a plodder on the highway, used to take him longer than anyone else to get there but since the company banned smoking in all trucks now he stops about every half hour and gets out for a ciggy. Now it takes him even longer to do a trip. :open_mouth:

I dont see what you are moaning about. Smoking is just not on. Do you smoke your house. Why should other drivers suffer. We can argue all day here but when i finish i want to leave the place tidy. Its just the principle.

As a smoker, I DO NOT smoke in cabs.

Sounds strange but I ■■■■ hate the smell of others stale smoke, and I’ve been a non smoker, and am trying again as I type!!

So for me I fully respect its nae fair too share with those who don’t partake.

Besides, if you’ve been sat for 3hrs on a poxy motorway, chance to get out an stretch is faaaar more a lure than sit an smoke in cab to me.

I don’t smoke in my house at all an never will.
On odd occasions I do in the car but even then I have windows down, an air it best as you can.

Trouble is it’s the tar that causes the stink to stay, it traps the odour an sticks to whatevers in its path, namely your cab roofs as smoke rises, vaping causes it too settle low down as its moisture based, and as we know water don’t run uphill.
Hence you can’t shift smell unless you remove the headliners, as there really ain’t much that’ll clean the tar outta fabric type materials, and if its vape you need to clean all lower surfaces too.

Coupled to pollen/cab filters that have never been changed an boom there’s ya problem, then you bang it on recirculation an ya wanna [emoji2961]

If its your own allocated an ya smoke, well its up to you but to me if its a communal cab, no no no as it ain’t fair to inflict it on others, simple respect issues to me.

The smoke gets into the upholstery, the door panels, the sun visor . . . everything. It’s disgusting. It’s also selfish.

So does sweat, too. Especially noticeable if the guy hasn’t showered for a … few days. I mean when you go to a gym you must bring a towel to lay on the bench even if you’re only using it for 15-30 mins but it’s ok to sit in a truck seat without one for 8-11 hours in the summer? The cab of a company vehicle is a defined “workplace” and it is therefore illegal for anyone, including drivers, attendants and shunters to smoke in the cab at any time, even when the vehicle is properly parked.
