Anyway, it’s academic now because the three of us piled in and went off to do what we had to do, I got one of the kids to hide behind the passenger seat just in case Angus was on duty today. :wink:

A seat is a seat whatever the design. So in theory (if its ok woth the insurance) sitting on the bunk isn’t illegal. So why not bolt a couple of seatbelts to the back wall/bunk and IMO you’d be ok

I asked a traffic police officer this question a little while ago. he said if he pulled the vehicle over and the driver was driving and i was a sleep in the bunk with no one in the passenger seat he would let it go. if someone was driving someone in the bunk and one in the passenger seat he would nick the one on the bunk as there is no safety device for them.

I am a bit new to this forum and the answer to the OP is not a straight forward as you might expect.

The seat belt regs come under s14(3) of The Road Traffic Act 1988.

It is an offence to

drive a motor vehicle or

ride in the front seat of a motor vehicle or

ride in the rear passenger seat of a motor car or passenger car.

I am no expert on this but it’s all about definitions. A truck fits in the category of motor vehicle so getting a ticket for the first two in a truck is obvious.

The last one a Truck is not a motor car or passenger car so that cant apply.

So a ticket for riding in the bunk in my view could be contested.

However if you have wound plod up enough then you could be reported for using a vehicle in Dangerous Condition (s40 RTA 1988) as part of that would cover the number of passengers carried and the manner in which they are carried.

Another thing to consider the seat belt ticket is 60 quid for the person issued with it to pay.

Dangerous Condition is 60 quid & 3 points for the driver and if it goes to court there can be a discretionary disqualification.

As the other posters have suggested some insurance companies have clauses as to the carriage of passengers and you have also got your company directions/policy to contend with.

The company I drive for bans passengers except for the driver trainer, double manning, breakdowns etc.

Sorry it’s a bit of a long winded reply but hope it helps in deciding if you want to carry someone in your bunk.

I would think Harry that as long as there is a proper seat fitted with seat belt as in LGV training vehicles then that would be legal.

Doesn’t mean it’s legal- only that they got away with it.

Well technically your bunks have seat belts (the webbing things you get with the 4 seat belt clips (Volvo/Scania not sure on a Renault but assume would be the same) so if you’ve got 2 bunks and 2 seats you can carry four including driver I suppose the only legal thing if you don’t have the webbing up if that’s failing to wear a seat belt there’s post on police special forum here about the matter http://www.policespecials.com/forum/index.php?/topic/112174-hgv-sleeper-cabs/

i,ve just watched Look north and they did a feature on south yorks police new silver actros, they had the reporter and the camerman sat on the bunk

I saw two young Slovak drivers and a girlfriend living in a TGA on Hamburg Docks once. I could tell that she had moved in and not just ‘visiting’ because the thing had more kit in it than my front room…

Certainly more fun than watching my back catalogue of ‘Trucks and Trailers’ dvds :wink:

Harry, I have just asked my neighbour who is a traffic copper.
You will get done. It is illegal.

If it’s adults it definitely isn’t illegal you can squeeze four mates in the back of the car to bomb down the pub and you can have adult passengers to any number sat on bench seats in the back of a Land Rover County etc. where there are no defined seats.

Whether some copper is going to issue a fixed penalty, like that ■■■ on that thread, and make you go to court to appeal it is a different matter though.
