You must request a follow up interview - as is your right. They have to give you 7 days notice by law, and in this time you should organize your own “chaperone”, this can be a member of the company or somebody you know if you let the company know in advance.
The reason for this is that you will benefit from somebody “taking the minutes” (making notes on the conversation between you and the employer and/or the third party).
They can either make notes or record the whole conversation via dictaphone. I would suggest that they make notes and you take a dictaphone discreetly into the meeting.
Before you enter the meeting, state your name, the date, who the interview will take place with and the situation at hand.
This way the company can not make a derogatory review of your comments nor can they in any way place blame upon yourself nor defend the third party.
After this, you should be satisfied with a result, however if not you have a solid case for magistrates with plenty of evidence.

thank you for your reply animal, I am taking on board all this advice everybody is posting. It dose not matter what gender anyone is , everyone is entitled to go to work & earn a living without being bullied or threatened.

in the event if I was to put a recorder on the table , & they refuse to carry on with the meeting , then where/ how are things likely to progress ? .

Then they are denying you the right to defend yourself and you have every right to request said interview be held with a “higher up” (director etc).
They most likely wont deny you the right to use the device but it is easier to hide it under light clothing etc. Try a couple of test runs first. This whole thing screams sexism to me and as I have said in previous posts, bullying must not be tolerated regardless.

In the majority of cases, you are on a hiding to nothing raising grievances within a company, because they have the right to conduct the investigation themselves, and if it suits them (which it probably will) they will be far from impartial, especially if you don’t have any real evidence or witnesses. They will most likely only be interested in following the law and not your grievance, so will just attempt to send you around in circles never getting anyway…

You basically have 2 choices, you either quit, or you drop it…

I’m a git who likes my revenge best served cold, so I’d drop it and let the offending driver think he has won. I’d then (if in your situation) set up camera’s and audio equipment and wait for the offender to get smug and complacent, as a leopard doesn’t change its spots. At some point he will (without provocation) resume his abuse and probably up the ante, as he hasn’t as yet achieved his goal. It may take some time, but it’s the only option you have except for quitting.

Whatever you do, don’t antagonise the perpetrator, as that tarnishes you!
But that doesn’t stop you smiling at him and being extra polite, as that’s bound to wind him up! :wink:

Thank you for your reply evil8breezle, the situation will come to a conclusion , otherwise things cant move on. You are right , a leopard doesn’t its spots, & this guy is a coward he’s not got the guts to own up to what he did.

What I would do is invite them to make their own recording if they are so uncomfortable about having a record with “all” the inflections of speech that are not apparent from a transcript.

e.g the question “how old are you?” can be a request for factual information or a put down depending on the inflection used. If they still decline then I would make sure that I take verbatum notes and make sure that all parties speak at a speed to allow you to do that.

This is the second meeting with minutes, & they have received a statement of the Incident from me , so why do they want to take more minutes? . If they have the relevant information then why has this not then be put in front of the boss to reach a conclusion. Is there not a legal time limit to conclude this situation? .

Thank you for your reply newmercman, I’m keeping a daily diary written of what goes on etc , this will come in very useful I’m sure ! I know I’m in the right & will not tollerate this abusive behaviour , or bulling from anyone.

Bullies are up there near the top of my hate list, deep down they’re cowards that only pick on those that appear weak. With those kind of people you will find that they will only treat you the way you allow them to, as soon as you stand up to them they usually give up before you end up showing them up for the weak pathetic little people they are beneath all the ■■■■ and vinegar.

I’m surprised that none of your workmates haven’t pulled them up on it and told them the error of their ways, I know I would if I saw somebody being bullied and without wishing to sound sexist, especially where it was concerning a woman.

I dont see workmates when I go into work , its a clicky little group that are the culprits, & I have made the boss aware previously . They are very bold in a crowd , but cowards individually. The boss has sorted it a few times but before long they start again. This last incident has gone way over top & I’m going to take things a lot further , something must be done.

Update , it appears now that the other guy’s story is different, & he is in denial of his actions. A second set of minutes have been done after another meeting. I have less seven days to make an appeal , or its brushed under the carpet!!!. Where the heck is the justice in that ■■?

I don’t think they can legally specify a time limit for your reply, as I think the legal guidance is “a reasonable” time limit. So you can, and should, instantly contest that time limit with them citing your reasons on why you need longer to reply. I’d guess they they are attempting to make the whole thing go away by attempting to make things as difficult, rushed and awkward as possible for you! As I said before, they are probably only thinking about covering their arse legally if this matter goes to a tribunal or court case. So if you detail why you need longer than 7 days to formulate your response to them, they will then have to consider their perceived position if they still attempt to impose a short deadline on you.

Tell them that you intend to appeal you do have longer than that to formulate your response seek legal advice but tell them this as well

Then sit back & wait
