A lot of questions will need to be answered, licensing of HGV Drivers and corrupt RTO Private Trucking schools, the way VICTORIA Police - By Law- write people up from travelling in a 110 KPH(65 MPH) Freeway to under 40 KPH in a few metres has caused untold collisions as Police often set up a radar further up from interceptor car to book people, so we have the situation of going from 110 KPH to under 40 KPH around blind corners etc - and no consideration for Trucks.Truck Driver has pulled the “I blacked out excuse” used so commonly with recent drivers with extremely dubious driving abilities, being rubber stamped on obtaining upto MC ( Road Train) HGV licence.
Driver of the truck was rightly detained by police in hospital as in Victoria numerous fatal collisions have had the accused escape to India, google Puneet Puneet who culpably killed a pedestrian whilst drunk and speeding and escaped to India and still protesting his innocence. Have attended crashes where persons have attempted to escape,the scene in question had the HGV swerve over several lanes of the Freeway and strike the police cars killing 4 Police, Extreme graphic pics are circulating- Taken by the offending car driver.

ozzyplod stop a car for speeding,he tests positive for drugs,they decide to impound the car whilst the driver legs it,and then a chicken choker truck creams the police cars on the hard shoulder which is really out of the car drivers remit after they stopped him.
is ozzyplod to blame for leaving 5 cars stopped on a main road where they could have moved off the main road to a safer refuge?

Yes, still perplexing in why Police won’t move to a safe area eg Off- Ramp etc to finish their job. Previous Fatal Police incidents when Police still take the “Combat Pose” when a car is pulled over here. Often they will position the Police car half way in a running lane,Also “Wire Ropes” Safety barriers leave no room for run offs .There is a growing concern that as the HGV deliberately moved over 5 lanes and continued to drive @ 100 KPH in the Emergency Lane/Shoulder.

theres always the potion that the truck driver just had enough,saw the scenario and lost the plot altogether .

Not sure on the runnings of VIC, but RMS here in NSW is A joke, I got an HR because, I had a Class 1 in the UK… I met some bloke at the side of the road with my log book, did a few hours driving … stopped by a maccy at Mittagong, awaited an examiner… didn’t show, drove for about 20 minutes he gave me my HC , I don’t have any medical. I don’t have a taco, I don’t even fill in the log book ( not that I drive trucks) … we have the 40k for our emergency lights, the VMS, tells them to move left right etc , I don’t like the fend off, even when behind a vehicle… a friend of mine who is in the UK and works for Highways England, He’s telling me how dangerous up driving is now… you should know the RTA system and the BFM is completely corrupt, the Hume, is a classic way of catching out fraudulent log book use here , with the cameras… time Australia had digital tacho’s most new trucks have the digi tacho in them, well 2014 or later Volvo FM do here in nsw, seen them.

what will happen to “mr singh” the truckie,
and,
obviously the car driver will get absolutely crucified by the media and judge,but
is the law of “failing to render assistance” applicable in the uk ? as it appears to be valid in several other countries.
never heard of it before,but surely its up to the individual to assist anyone or not?
you might try to do something even with good intentions and end up sued because you did the wrong thing.
it seems to apertain to a hit and run scenario,but he was being held by the cops which makes me ask the question.

Iirc failing to assist was what the paparazzi were charged with after princess Diana’s death in Paris but no such rules apply here unless it’s you that’s involved in the accident. Even then, I think you’re only in trouble if you actually leave the scene.

As for getting sued, again iirc, theres something about acting in good faith that protects the aid giver. But that’s a uk thing and I have no idea if that applies elsewhere.

We have six srates and two territories, writing laws, so while the detail may differthe essence remains.
In Queensland one can be charged with failing to render assistance. Dependent upon circumstances such as qualifications, experience and abilities as to wether the charge would be laid, prosecuted or proven. There is also “Good Samaritan” legislation that protects givers of aid from being sued. The threshold being commensurate with qualifications.
This grub has had the book thrown at him, being hit with a raft of charges. He’ll do close to ten years.

It has been reported in NZ news today that the truckie was also in possession of a meth pipe.

It’s a sorry saga for all those involved in this series of unfortunate events.

i wasnt having a pop at you or anything,it was just the rendering assistance bit i was wondering about.
personally,i would or wouldnt depending on the scenario,but either way i wouldnt be wanting to ponder over the legal ramifications of whatever i did.

No I know you weren’t having a pop at me. I’d be inclined to agree with you to be honest, only you know wether you can help in any way, the law shouldn’t really make you

I think the law of common decency would compel the vast majority to render assistance, even if it was just some BS reassurance.

The truck driver has now been charged with four counts of culpable driving causing death.
It has been alleged that drugs and an ice plpe were found in the truck.

A selfish, downright nasty Porsche driving maniac and a crack head truck driver all meeting on the same stretch of tarmac at the same time.

If the charges stick to the two accused, I hope the judge just throws both keys away.
