Yep ‘exclusively’. On the starting blocks and listening to Polish (other languages are available) isn’t exclusively recuperation (I’d go for partial recuperation at best) so they still owe me one, which I will take at my leisure later on…
Course when push comes to shove (quite literally in this case) and faced with parking up an hour from base or getting home to the wife when on a promise all bets are off and its break whenever the wheels aint turnin.
I will quite happily explain to VOSA that I was using break due to a high probability that coitus was on the cards and I will take the infringement as its a lot better than the infringement the missus would give me if I hadn’t got home for said relations.

So what if it messes your day up, it’s not your problem it’s your bosses, when have you ever delivered to a supermarket Rdc and they have told you how long they will be.I put it on work every time because that is what I am doing.
then that could be classed as falsifying your tacho, as you are not helping unload the vehicle, you are sat in the waiting room picking your nose or what ever, and not carrying out any work at all

Your not falsifying your records at all, waiting at an RDC does open up the 3 options: Break, POA and Other Work to drivers choice. Often that choice will depend on the drivers contract, situation or choice and its all down to justifying your decision which is easy.
Break= Dear VOSA I choose this option because I went to the waiting room and deceided to have kip it doesn’t get more exclusive recuperation than that.
POA= Dear VOSA I went to the waiting room and they told me its about an hour to tip thats good enough for me and I relaxed whilst I waited and funny enough it was an hour, if longer ask again and do 2 hours POA etc.
Other Work= Dear VOSA I went to the waiting room but couldn’t settle because I didn’t know how long it was going to be and felt like a greyhound in the traps waiting for my bay to be called.
Its all down to individual choice and if that choice will help you out or help your employer or a mixture of the two, I choose to help myself first so it goes on break but its debateable if thats correct, for me it is and I could defend my choice of mode.
If its a long wait it would be break for an hour then other work until I was informed of the length of the delay then maybe onto POA.
If I wasn’t allowed back to my truck to change modes I would make a note on my printout.
Just my interpretation though.

Even the bluetooth dongles don’t change mode.
I do it to the letter. Except in one place. Our beloved capital. Will gladly use any mode at all, when I have 6 or 7 drops on, if someone will tell me where I can legally take a 45.

It’s not a break as you have to walk to the office and deal with keys and paperwork.Our Chief training officer had a word with VOSA about this a while ago and they said to him as long as you show at least 5 minutes extra on top of your 45, 30 or 15 it’s not a problem as these 5 minutes at least extra compensate for you walking to the goods in office etc etc.
I know what your saying BB but then VOSA are telling you to make an illegal record on your tacho
They’re not telling you to do anything, they’re simply using common sense to overcome a problem that generally doesn’t really exist in the real world.

If your paid by the hour and have your break deducted,
why give away 45 minutes of your time.You are NOT freely able to dispose of your time in a RDC waiting room. you cant have a smoke, go to sleep on your bunk, have a private conversation with the wife etc…

My pay has nothing to do with my tacho policy on a loading bay.
I am well paid and I give great service.
Being awkward like many other drivers is not part of my menu.

and my future health to get involved with that filthy habit.
Can office staff flake out on their bunk ?
Why not go outside and phone the missus.
I use break because I always like to have four and a half hours
drive time up my sleeve. It often gets me to where I want to
be without breaking the drive time law.
There is nothing to stop me having another 45 break during
that drive time if that is what I want to do.

I expect the RSA is the Irish Vosa.
If vosa or the rsa asked a driver to do something and the driver obliged, Then the driver is no longer on a break. If the driver stayed in the waiting room and said “sorry mate, this is my time not yours”, then he would still be on a break.

Yes it is,so is lidl seen them quite a few times in the one at Livingston.
They work in 3s by belvedere. One sits outside then radio’s the reg to the others. One at the ferry and one by the snack waggon before the tunnel. I always make a point of stopping there for a break. They leave me alone then
For me it really depends on a few things, if there is no where for me to get a hot drink, or warm up some food it goes on POA, if there is or I can sit in my cab it goes on Break.
Another big thing is if there are no toilets available to use it goes onto POA too.
I would put it on break if it was in my interest to do it, it also depends how you are paid, if your not paid for POA or breaks it goes on work!
You’re the captain of your own ship, use what mode suits you best in your own individual circumstances. If you’re someone who doesn’t get paid for any time on break on your tacho then use POA or Other Work. If using huge amounts of other work will eat up too much time and reduce your earning potential later on then just use POA. Personally, I’ve always done more longer distance work, away all week or longer and paid by the day, I’ve never being the slightest bit interested in being stuck in a RDC for X amount of hours, then pulling outside for a 45 minute break. My work ethic wont allow me to do so, I’d rather just crack on and get the job done and finish quicker, than hanging the job out and driving productivity down. But this is from a day rate perspective, I fully understand why a driver would not use break mode while on a bay if they don’t get paid for it. So it all boils down to whatever suits you and how you get paid and how keen you are to get a move on afterwards. Whats right for me isn’t necessarily right for you and vice versa.
Here’s how I see it.
When I have backed onto the bay I have to leave the mode on cross hammers as going into reception, handing in keys etc is work.
Now I go into the waiting room and as has already been said I choose to have a kip - therefore i want to record break, but of course my tacho has been left on cross hammers and by rights I shouldn’t be going back to my vehicle.
So … having read the GV262 it tells me when working away from my vehicle or unable to oprate the recording equipment I can remove my card and carry out a manual input once the recording equipment becomes available again.
So … I back on the bay, select cross hammers and remove my card. I make a ‘note’ of the time I finish booking in and start my break, I make a note of the time my break finishes and work begins again. When I get back to the vehicle I manually input these to fill the time from when my card was withdrawn. My record is now complete and perfectly accurate.
As far as I can see no offence has been committed.
If I was on analogue - I’d remove the chart and manually complete it on the back as I go … then back into the tacho when I am back in the vehicle.
