He’s going to go to prison for driving without a card for 3 miles?

Riiigght.

No wonder prisons are so full, full of truckers with minor infringements.

And I actually said to just admit it as he has the print out, but that part obviously didn’t suit your agenda.

It won’t be on his card though, it’s on the unit, as his card wasn’t in, so nothing can point directly to him unless he admits it. He has the print out, so that’s all he needs.

Apart from his card having been used directly either side off the event, which proves nothing, but points in a general direction. I think honesty is the best policy for this time

But it wasn’t, not they way I read it. He drove with the card in, pulled card when he arrived at dealership for repair and left it for a few hours. Then drove it from dealership, stopped a few miles away and Inserted card. It could quite easily have been a Mechanic driving it at the dealership and the poster didn’t start driving until his card was inserted picking it up again. They could never prove otherwise, except for these posts and the fact the poster admitted it. Even so, it’s hardly crime of the century, just tell them what happened and deal with the consequences, which will likely be nothing, maybe a verbal warning to be more careful.

Apart from checking with the workshop which might be unlikely if that was all that was on his card in the way off infringements, but is always a route open to VOSA if they see fit.

Yes I noticed that, but I didn’t understand why you led with all the rubbish 1st, when you finished with such common sense.

defo take a soliceter with them, they will be asked to explain the discrepincies under caution, vosa will then go away and consider charges for them

Do you think they will have to take there digi cards with them

yes and any tachcos or revalent paperwork they have demanded

rule 1…Stanley the card, and apply for replacement,
rule 2…hope the traffic office take the penalty for non producing rather than a million separate recorded offences.
it used to be the office got burgled and they must have stolen the cards,or,the cards were in boxes in the boot of the car that got nicked(and subsequently burtout)…I suppose now itl be someone took a hammer to the computer, then burnt it for badness…coincedences happen happen. but Stanley the card 1st.

Haha , well it’s d-day for 1 of them was in at 9 I think I’ll wait to hear off 1 of the lads later see what the outcome is … His brother has got to go next month !

Been caught driving with his brothers card 7 times , got to goto court in a few months time and then traffic commissioner I think … What do you reckon ban ?

I reckon a 10-15 year stretch minimum at a cat A prison like Wakefield or Frankland where he will be lodging with the worst of the worst like Huntley, Bellfield, Whiteing etc. He’ll come out a completely changed man

He couldn’t handle a day nevermind 15 yr lol

As you’ve been told many times, this is pointless as its stored in the tacho head as well.

If you get a new tacho is all info lost or does it go on the new card ?

Smoggie89:

If you get a new card there will be nothing on the card but all the data will still be on the tacho head, or heads if you drive multiple vehicles, and the operator(s) will have the downloaded data which they have to keep for a year, or two years if they use the tacho to monitor the WTD.

‘Losing’ the card is a pointless exercise, especially in a situation where you are already under suspicion as that’s just likely to make the authorities dig deeper into your driving history. As these drivers are already facing falsifying records offences they would just be adding fuel to an already serious fire.

Didn’t think it would be lost lol stupid if you ask me , not too sure what will happen to them but having to goto court and then in front of the commissioner can’t be a good outcome , was in 1 of the magazines yesterday 4 got caught and they all got jailed , wether these 2 are worse I don’t know

if the firms any sense, the tachos will get binned also…1 big fine for no evidence is always better than hundreds of smaller offences…knowing and proving again…if your in for the high jump, then bin the noose that’s going to hang you…that’s why traffic offices spontaneously combust immediately before a nose to nose with gruppenfuhrer bell and the likes…

Because ripping the tacho heads out of all the vehicles just as you’ve come under the scrutiny of DVSA isn’t at all suspicious. If you think that all they’ll get is a fine then you’re deluded. Its gone beyond mere driving offences to perverting the course of justice and that comes with serious jail time. And then there’s whether the TC deems you to be still of good repute. If they don’t then its bye-bye O license and bye-bye driving licenses.

Couple of people reckon these will get away with just a fine/ban or both , I’m just curious as what they should be expecting

It’s more than just hour’s offences, this is falsifying records or fraud if you prefer. I don’t think they will get away with it or even escape with just a fine. For the drivers at a minimum I would expect a loss of their licence for a period from the TC and they could even be looking at a prison sentence when they go to court. Plenty of examples in the trade press of drivers who have committed similar offences ending up inside. For the company it will probably mean loss of O Licence or having it severely curtailed.
