Striking a deal

Went to look at a merc actros today, private seller, i rang him yesterday and he said a bloke was going last night to have a look and he would ring me after, anyways i heard nothing so rang him this morn at 10am and asked if he struck a deal, he said the chap never turned up till this morning at 9am and was going to ring him at 12ish today with an answer, so i said i am half an hour away and will have a look, went down looked at the truck and went for a drive and offered him asking price, he sucked his lips and said he needed to offer the other chap first go and went off to ring him, he came back 5 minutes later and said the chap would be in the yard at 9am Monday morning with a bankers draft and if at 9.30 he wasnt there i could bid him, which i thought id already done?
Anyways i rang him later and mobile goes to answer service, i told him i would BACCS the money across today if he accepts my offer but not to bother ringing on Monday. I am a little confused, am i wrong?

The guy selling the truck gave gave someone first refusal ( probably because he rang first). your dealing with someone whose word is enough and will stick to it , regardless of you trying to jump in and buy the truck !

My thoughts were the chap had looked and said nothing, ‘GAZUMPING’ is a term reffering to someone upping an offer isnt it (sorry im not that into wikipedia and have not read their definition) but no offer was made by the previous viewer just a promise to call.

maybe gazumping was the wrong explanation but I thought

But i made the first offer of full asking price, the first viewer said i will let you know, anyways the moment has passed, i dont do ‘sidelines’. Where i went wrong was that when the vendor said ‘i will go and ring the other chap’ i should of said if you walk away from me i will walk to my car and goodbye. My other forum mates reckon i was bonkers trying to buy an actros anyway :confused:

Maybe it’s just an old fashioned way of doing deals, but I can see where the seller is coming from ! He had given the first person first refusal , your attitude of “offering more money so you should sell to me” doesn’t suit everyone :wink: His reputation as a seller may be important to him and maybe the first person had done business with him before.

Also, If I was the seller and you threatened to walk out if I didn’t sell it to you I would have opened your car door for you :wink:

OTOH your other forum friends are right, you must be bonkers trying to buy a Actros :grimacing: (and even more so at the full asking price! )

do you know what a bankers draft is ? You don’t promise to bring someone a bankers draft if you haven’t made an offer .

If you own something, it’s up to you who you sell it to. There are any number of reasons why a seller might wish to sell to one person rather than another.

Whenever I sell anything i will keep my word, but, if he says “I’ll be there tonight” & doesn’t turn up till next morning I wouldn’t be taking his word & I’d make that very clear. From that moment on my opinion of him would be tainted & if he asked me to give him time to think I’d tell him that if anyone came along while ‘he was thinking’ I’d sell it in a heartbeat!!

However, his loyalty to this ‘other guy’ might be a message & you might just not be ‘meant’ to have it. (I’d probably ‘walk’ at that point as well)

You dont seem to understand!! i made him an offer to buy his truck, nobody else had made an offer, he took my offer then used it as a lever on a person who viewed but made no offer, then that person made an offer and promise of an appearance with a bankers draft. Do you understand??

I will take this thinking and thank you. My father died at 82, all his life he had dealt in cattle, buying and having buyers in Scotland in the 50’s 60’s and 70’s and the cattle coming down on the train, then just dealing in England. Having stood on the end of a cattle halter for many years and being privy to the deals that were made in later years i would hope i understand the principles of ‘good conduct’, i take exception to you Dennis f of accusing me of gazumping when i was the first person to make an offer and i also take exception to being used to extract an offer from a previous viewer.

I shook his hand and accepted, nothing legal had changed hands apart from my word and a liking for the guy, next day I turned down a higher offer from his competitor… My house, I had shook the guys hand on the deal and would stand by that…

maybe unknown to you the guy selling the truck also liked the other guy, and promised him to listen to his offer …

I suppose, i give up, money is money is money, the seller did say ‘dont bother bidding me as im not bothered about selling’ i did think what a [zb] with this statement but i dont know the mentality.

The first one to put money in my hand everytime. So many people have promised to be back in the morning with the money…

Maybe the buyer is a friend of a friend, maybe the buyer was going to put the lorry to work for the seller, maybe the lorry was stuffed with a “substance”

It wasn’t meant to be having a go at you , it’s how I read the situation using the information you had given .

Because you may already have an established relationship with one buyer and know that dealing with him will not be problematic, whereas with somebody you don’t know there could be unpleasant comebacks.

I really don’t know why you are upset about this, the market is awash with second hand trucks for sale, just go and get one of the others.

I can see both points of view & both have some merit, just do what’s right for you, seems to be a bit of faffing around involved so walk away.
