Stobart has to pay for disturbing drivers rest

drivers want money for nothing.folow this situation must make restriction to drive car.some drivers in weekly rest sleep just 4 hours ,back to work Monday with really not rested,but phone call taked to many power???may be some silicators want extra job .

Our lads get told at the end of their shift what they’re doing the next day, but sometimes we will call/text to let them know if an extra drop has come on or off. They like that as they can change their start time to suit. If we didn’t tell them, we’d get moaned at for not telling them!

I worked for an agency in Swindon a few years back.
Did a long night shift thanks to a tail lift on a trailer packing up.
Got into bed at 06.30 and the agency called at 09.00 with my time to start that night.
I never did any work for them again.

This ■■■■ is getting way too technical. I’d say pop me an email with information for week’s shift etc and I can check it in my own leisurely time when it suits… will doing tax returns be classed as “work” next?

If you read the report it says the drivers were required to call in and find out their start times during their weekly rest.

Sometimes they had to call several times before they got a start time.

This is a clear interruption of their weekly rest…their employer’s lack of organisational ability is self-evident.

The legal work-around would be for their employer to contact them by text or email, which they could then check as and when they chose after they had completed the minimum rest period required under law.

I used to get similar pressure from an employer in another field…given something to do on a Friday pm “for Monday”

“I guess this is really important and urgent then?”

“Yes, it is”

“But not so important and urgent that you didn’t think to organise the task so I had time to do it properly then?”

“Errrr…”

“So, I’m supposed to give up my weekend to get you out of the mire?”

“Errrr…”

“If you were in my position, what would you say?”

“Errr…”

“Are you in a position to arrange a substantial payment to compensate me for the lost weekend?”

“Errr…”

“Remind me again why I should cover up your inefficiency.”

and so on.

They don’t do it again, that’s for sure!

i would think 99% of drivers have made or received phone calls or texts regarding work while they are on daily or weekly rest…

isnt it just…but the paddys got paid out for it,so imagine if you were a long term driver working for a similar beancounting type of firm,and imagine if you were to decide that all those phone calls made to your company during your daily or weekly rest was classed as other work,or unlawfully interrupting your rest…and imagine you went to a better call saul type of slimebag lawyer/compensation no win no fee firm.then imagine the subsequent court case,payout,and early retirement for said driver,assuming the payout was greater than the fine from vosa for not having taken the required daily/weekly uninterruped rest for a perid of years hence…just imagine someone did that…the paddys did it.it might not be a test case in uk law,but it would be if someone decided to do so.probably you would have an out of court settlement so as not to set confirmed case for the rest to follow.imagination is a wonderfull thing… :wink:

I could see why you might be a bit ■■■■■■ off about someone ringing you while you’re trying to sleep over you 11 hour break and it’s been a long day, you’re tired, long day tomorrow etc. But not enough to warrant compo!

With the work I do there’s constant back & forward emails and phone calls to the boss about my driving schedule. Literally every day something has to change, wether that be updating the schedule as I only got a reduced daily or weekly, I can’t park up where I planned overnight, I need to move the truck after it’s been unloaded and find somewhere else to go til the load out, any plans for equipment to come off the truck because it’s broken or new stuff to go on etc etc.

My boss would never ring me at an ungodly hour unless it was an emergency, and I think I’d rather answer it than ring up childline and moan that he’s interrupted my beauty sleep!

My boss will text me at home, asking if it’s ok to ring with the following days’ work details. I have no problem with it I can then start when I like and be left to get on with it.

apart from phone calls,
I spend about 20 mins every weekend doing my timesheet, tacho download , etc , and emailing it all to my employer…

I’m putting my case in front of a solicitor this weekend…

No their right why should you have to keep ringing in if your not getting paid, it’s work, time off is time off, if your an owner driver and you do paperwork at the weekend it’s still classed as work.

This should be easy to police. Don’t ring the driver till after he’s had his legal time off. He then loses a days work as the shift he was going to get has gone to someone else. He’s having a 45, 24, 11, whatever, but then doesn’t get contacted till after the rest period is finished. So, therefore, if he’s on daily rests, he’ll only work half as much as he may want to. He’ll soon spend the compo he received. Obviously, you’d need more drivers, but some might be happy only doing part-time. Hope that makes sense to you lot?

A bod from our traffic office once rang me at 2.30 in the morning on my personal mobile. Once the shouting had finished he asked me what time I was starting, my reply was I’m getting up in three hours but I’m booked on from 5 minutes ago since you called. I got paid it and he never did it again.

A 30 second phone call, lord help me!

So how long before some bright spark insists we take 45 hours alone in a darkened room to ensure a proper rest ?
