Sounds like you’ve got a claim there mate. My pupil got in touch with DSA, they sent her the forms, I had to sign to confirm her expense with me on the day, I assume your trainer will need to do the same. I guess you should be able to get at least the days training back…worth pushing for a couple of days though seeing as you were on an intensive course and had taken time off work to do it!djw may have a handle on the legal side of things
I’m not entirely certain what the contractual position will be, not least as the strike will likely trigger some sort of force majeure clause. However, DSA have a policy of offering discretionary payments if tests cannot go ahead for unforeseen circumstances and I believe this policy applies in the case of strikes. It is always better if you can negotiate a satisfactory outcome rather than resorting to a more legalistic approach.
You will need to make a reasonable claim that aims to put you back into the position you would have been had the test gone ahead. You will need a new test date and the use of a vehicle for that test, plus some training to freshen your skills before the test.
I think Tazbug’s approach is correct - claim for somewhere between half a day and a day of training / vehicle use - whatever your instructor feels in his or her professional discretion is correct in the circumstances. If the instructor can write you a letter on headed paper explaining that you attended the test centre with a suitable vehicle but the test did not go ahead, outlining the cost of any necessary refresher training for a new test date and the cost of you using their vehicle for a test, hopefully DSA will be amenable to paying up.
If you will lose income from taking your test on another day, either by having to take a day off work or needing to refuse a day’s driving so as to get your weekly rest, explain how much you will lose and how you have come to that figure. Add your loss of income to the claim for refresher training and use of your instructor’s vehicle for a new test to get a total figure to claim.
I hope you can get this sorted out soon and get your CE test taken.
well i rang dsa on monday and they said i couldent claim due to it been a organised and legal strike but today i got a letter off them sayin they had canceled the test and some forms to fill in for a claim so slightly confused by that so going to fill it all in send it off see what happens.
also got a test date for the friday, they have called in a instructor they use to cover holidays because they had the truck free but no instructor to take me to test center, they are giving me the time free as if i hadent had the friday at all so am not out of pocket but i havent got any lessons before the test so got to be there at 12 for my test at 2 so got hour and half drive before my test so will take some serious remebering about it all

well had my test today at 2, anything that could have gone wrong did, car broken down on a roundabout another car changing his mind where he wanted to go and reversing on a duel carriageway but apart from that passed it with 6minors so am happy with that

cheers, got there in the end i guess few ups and downs but now all the driving tests done only cpc to do now and am all set

ye that will prob be a month or so because gota wait for licence bk then book it round work but least hardest part is done
