I would imagine the one who’s tacho was in slot 1 at the time of the offence.

The person who is driving at the time of the offence is responsible. How can the person in the passenger seat be to blame for any offence?

which he will, then itl come down to a card download to prove whos who unless your employers decent and vague about it.
One who is driving at the time with card in slot 1. How could the passenger who is on break/poa and possibly be asleep be blamed for any offence and take points on their licence for it?
This might be slightly off topic, but if you were driving double manned and got pulled over by dvsa for a vehicle check, who would be responsible and take the penalty for that? Would it be the person driving, or could it be the second man if they’d been the one to fill in and sign the vehicle defect/check sheet?

There should be 2 check sheets . Each driver is responsible for the vehicle when he/she is driving. If pulled by DSA, /police the driver at the time is responsible for the vehicle as is.
As regards speeding it is down to whoever had the card in at the time (can’t actually believe the original question was asked!)

Always the other driver of course !
Raises the interesting scenario should double crews ever be tempted to use each others cards. In OP scenario the company could simply notify that it was both ‘drivers’ in the vehicle and leave it to them to confess who was driving, or check the tachos/ telematics and see who it was and notify the authorities that way. Either way, the driver will get identified.

Imagine waking the second driver and saying “hey buddy, I just went through a speed camera, so that’s £100 you’ll have to pay and 3 points as well, sorry about that”
Would you take the points and pay the fine if you were in passenger seat of a taxi and the taxi driver got flashed?!

If your talking about being done for non traffic offence stuff like speeding or being in a red x lane, and you mean get pulled and they find a vehicle defect or they aren’t happy with the load security and that kind of thing then I guess they would hold both responsible as well as black mark for the company.
I wouldn’t double man because I hate the thought of being sat in a box with someone I potentially don’t like or someone who feels the need to have to talk ■■■■ for the whole shift. But if I did I would certainly want to check the others drivers load security if he’d loaded and I hadn’t before setting off, and if not happy discuss changing it before continuing.
The driver at the time will be responsible, not sure how a passenger can be.

The check sheet is just a piece of paper as far as DVSA are concerned - its only function is administrative arse-covering for the company/operator, as part of their compliance procedure. Regardless of the existence of said sheet (how many, or who signed it/them) the buck stops with the driver if defects which should have been apparent during pre-use checks are discovered during a roadside inspection.
Easiest thing to remember is that the driver is responsible for everything. The driver is the one responsible for ensuring that the vehicle they’re driving is safe and legal.
