Careful Conor. Saying things non argumentative will get you liked!

I would imagine the one who’s tacho was in slot 1 at the time of the offence.Sent from my iPhone using Tapatalk
This.
Because…
There’s two drivers it’s twice the normal amount.
Everyone knows that.
End of thread.
Conor:
Easiest thing to remember is that the driver is responsible for everything. The driver is the one responsible for ensuring that the vehicle they’re driving is safe and legal.
So the 2 of them then, that’s no help
If the offence is likely to result in a licence endorsement as well as a fine - wouldn’t it sometimes be the case, especially at “Family Business” yards - where the firm upon being given the citation - neglects to tell the authorities who was driving at the time, and just pays the fine attached “no quibble” as a way of preserving their (family?) driver’s livlihood?
At the other end of the scale, a firm can receive a fine, insist upon the driver that they have NOT named to the authorities to “pay that fine” - and then sack them if they outright refuse…
“Appealing” - doesn’t do one much good, as the appeal means the full fine ends up being paid, rather than the discounted version, if one just elects to cut one’s losses…
“It’s not fair!” isn’t really the basis for an appeal, after all…

Jesus, really? How can 2 people drive the lorry at the same time? The driver as far as the law is concerned is the person in control of the vehicle, the person sat at the steering wheel. The other person, even though they’re also employed as a driver and may have driven that vehicle even 5 minutes ago, is a passenger.
I can’t believe some of the questions posted on here. Whatever next? Perhaps something like “why do I keep seeing lorries with one axle raised in the air, why have an axle of you’re not gonna use it?”
It’s quite worrying these numpties are let loose with a lorry really
sad but true, but thats the effect of letting companies like stobart and tesco dumb the job down so that a kebab in a hiviz is capable of chugging through a days tasks similar to a burger flipper in kfc and the likes.
if your boss is a good guy, then its no probs to refuse to name the driver and take the fine depending on whos paying as limited companies and the likes are unable to receive points.( note to owner drivers.go ltd.)
the other normal option is to reply stating that the drivers details were bogdan kawalski,of 123 nowhere street ,(pick your own town in eire) or europe, who only worked for a few days before leaving the truck abandoned somewhere hence you have no further contact for him.
there may be a minor follow up from officialdom, but nothing to break sweat over.
mostly this course of action only applies if you are on good terms with the company owner.

This might be slightly off topic, but if you were driving double manned and got pulled over by dvsa for a vehicle check, who would be responsible and take the penalty for that? Would it be the person driving, or could it be the second man if they’d been the one to fill in and sign the vehicle defect/check sheet?Sent from my SM-G973F using Tapatalk
At a guess BOTH 1st Driver for taking the vehicle out in the first place 2nd Driver for allowing it happen knowing at some point he would be required to drive.
Vehicle has to right no matter whose card is in slot 1 or has been in on that day.

Except the passenger who is not wearing a seat belt, as long as they are over 14 years of age
