Hi all.
The IR35 legislation is quite complex and when considering employment HMRC will weigh up all of the facts and do not usually focus and one issue alone (one employer in this case). It would therefore take much more than doing one particular thing to stay outside of IR35.
If the Revenue investigate a contract and decide it is “caught” by the IR 35, THEY WILL CALCULATE A DEEMED PAYMENT, TREATING ALL INCOME RECEIVED AS SALARY AND DEMANDING ALL TAXES AND NI CONTRIBUTIONS ON PAYMENTS ORIGINALLY PAID OUT AS DIVIDENDS.
My asking is, are you SELF-EMPLOYED or a CONTRACTOR working through YOUR LTD?

Yes he would btw thats what many drivers do. Much better than a 0 hr contract which is what they are making you through the back door

You seem to have quite a knowledge on this. Is IR35 still well and truly alive and kicking or has the government eased off with the recession?
A zero hours contract is worthless, as it guarantees you nothing. Are they going to pay you to sit around waiting for their call… No, therefore you are free to do what you please.
I would take it as self employed or ltd co and forget the paye zero hours contract. Don’t worry about IR35; HMRC will only be interested if they think you are fiddling them out of large sums of cash, not a thousand or so - it’s not worth their time to look into. Register with an agency or two, self employed, if HMRC do sniff around you may have done the odd day for the agency, if not you just say it was the only work you were offered.
I am afraid not only is alive and kicking, but rather besides, seems to be Contractor livelihoods are under threat by a proposed test of false employment arising from the Autumn Statement. It could force all contractors, including those trading via limited companies, to pay Pay As You Earn (PAYE) income tax and National Insurance Contributions (NICs) on all assignments as per the proposed legislation as it is written would introduce a completely new test of false employment.
The best is yet to come.
I’d actually say be careful going Ltd until your sure, I don’t know anyone that pays less than £1000 for their accounts as self employed you’d pay £150-£200.
Go see an accountant & clarify with said company.
A zero hour contract is a complete CON. It basically means you are an employee of the company when they want you, BUT are NOT entitled to bugger all except what they want to pay you. Most companies use these to try and shirk out of their responsibilities eg holiday and sick pay, some companies use these to try and con you if she has work for 48 weeks of the year WHY doesn’t she take you on full time then ? What will you do if the company don’t need you for the next few weeks or days and there’s no money coming in. How long will it take you to then sign on again.

I agree - no need to become LTD… and if you’re knuckles don’t drag on the floor it’s a piece of cake to file a self assessment yourself at the end of the year - no need for an accountant with Google as your best friend…
If you’re going to be proper self-employed, then you set your own rates - which are going to be somewhat higher than £12ph or whatever. To cover your own insurances, etc. you just cannot be employed on a zero hours basis at the same low rates as PAYE, because you’re going to go broke within 3 months - at least at this time of the year.
I can’t see an issue with you taking it in as LTD or LLP.
Self employed wouldn’t be too much of an issue either. As long as you can show other “customers”
Personally I am LLP and I invoice about 4 customers every year. One if which is always MIL and payment is never forth coming. But you don’t have to be paid only generate the invoice.

Its all been sorted now. I went into the office and told them i was not happy going s/e and not happy with the zero hours bit too
So i am now on paye on £11 p/h with 40 hours per week including No zero hours contract
hopefully 2014 could be the one lol

if you do this you can not reclaim vat on any purchase under £2000
