Don’t bother wasting more time with letters. You have sufficient proof that you have tried to get the money you are owed in the returned cheques.
Straight off to the small claims court and don’t let them tell you you have to sent more letters even though they will try to do just that (they don’t seem to want to do any work other than community charge late payments at most courts). If you know he has lots of money and is just being a pain and trying to give you the runaround, you could of course go through the dearest barrister you can find and get him to issue the writ. His charges will make the bill seem like chicken feed.

True what you say as I phoned Vosa today and found out that a company needs at least £4000 in the business account to carry on, they said they would put it out to the officer in that area, so thats him ■■■■■■ on that side of things.
They also was very helpful and put me in contact with a firm called Acas who deal with getting money off companies when its owed and stated an officer will be in contact

Fair enough, any company can have bad times where someone goes to the wall (always a bloody LTD company ) and leaves them a bit tight, I’ve had it happen to me and had to wait a while for my money, but the firm involved was straight up about it and fighting for it’s survival. That’s different to this guy who seems to be taking the urine a bit.
Incidentally, a company near us who went bang a couple of years back due to a LTD stitch-up, wanted to pay me back when they got their first other cheque come in, even though the directors wouldn’t then have a penny for themselves. I said lets split it three ways so we all have a bit for xmas and you two have a serious think about things regarding whether it’s worthwhile carrying on. Then went bump shortly afterwards. The lads came round and paid me out of their own pockets a few weeks later. They didn’t have to but were so grateful that I was prepared to be reasonable.
At present, I’m owed £2500ish by a race outfit, who got screwed by a sponsor, promise one thing, give another. Usually 50% if your lucky but there’s nowt I can or will do if he ain’t got the money. It’ll come one day as he’s an honourable kind of guy (rare trait nowadays). But I would be very different if I thought for one moment he was taking liberties and he knows that.
(And I know for sure the truck is looked after properly, not skimped on else it wouldn’t move a wheel!)
At the end of the day I have been polite always said could I please have my wages, I have been very patient as I have waited over 4 weeks now and with Christmas next week thats very kind of me. I have been told I have been to patient and polite, I have left polite messages on his phone and to which he cant even telephone me back in politeness never once has he returned my call. I went to the yard to see if he left my wages in a truck of which he said once he would do, what a surprise I wasted my Saturday night searching all the lorries tried phoning again and what a surprise no answer. I then go to his house the same night what a surprise he was home he then shuts the door in my face with out a word said, so I then waited outside in the snow and after 10mins he returns with a rubber cheque
After all that ■■■■ I would say I have been very nice, if the TC now goes and takes his licence then so be it I dont give a monkeys now to be honest I hope they do
Vosa stated the officer will inspect him and that Acra firm sounds promising too usually get results within 12 weeks from last payment due date and said as its been so long you should recieve your money in Jan if by some chance they dont get it (sounds rare) then they have to be taken to the Tribunal
I think he wiped the business account so that when I cashed the cheque I couldnt get anything thats why he post dated it a week, and I also believe he either hasnt got much money or his got it all in the personal account sounds to me though the TC will want money in the business account at all times
He has money his got to fuel lorries everyday and when I went in yard them lorries had been driven all of them, I noticed the food and alot of rubbish in mine someone had been eating alot of lunch so must of been far and the middle seat was up I always kept it down (Fbi here I come )

No not Harsh, there are too many of these phoenix companies, Busted & Son come back tomorrow as Busted Logistics using the same vehicles, same offices and same office staff, just don’t pay last months fuel, rent, leases or wages!
If VOSA dont help, a visit round to the house with a couple of large friends may have the desired effect, it may make keebs feel better on Christmas day
Keebs is this a one truck operation? meaning, are there other drivers who have not been paid from these charlatans?
I started my first job as a lorry driver a few weeks back its on self employed basis for a small company with only 3 lorries.

I have no idea if the other 2 got paid as I never bumped in to them on my last day there, and only worked there a month so not to sure of there exact address. Only way to find out would be to wait there at the yard one morning to ask one, im guessing they must have got paid or why else would they still be there unless he has got some more mugs in

Well just thought I would update Acas couldnt get hold of him and he ignored there calls and letters, so I then went Moneyclaim online route they gave him 14 days but still no reply to court letters.
I have just a few days ago issued a Judgement against him he has 30days and then if he still ignores everyone its the bailliff route Iam told, but thats £100 at least, and then what they go to his house where the business is registed only then to find that theres nothing that belongs to the business in his house so they then cant take anything

Name the culprit and his location. Are his trucks sign written? you could visit the place where he has his repairing done as they prob would like the warning - and may not deal with him no more. It wont get you your money, but you may earn friends through it.

if you mention to vosa his chequs bounce thay will be interested as he will fall foul of ‘financial standing’ rules. although this wont help you too much. mention to him that you may say some thing to vosa about this may just help.

No they dont have signs on lorries you can normaly find them at Karl King, GMA, on Rasomes or PTS in Nacton, or Suffolk Transport on farthing Road Ind Est all in Ipswich
There are 3 lorries x2 7.5toners both Iveco both white cabs, one a blue curtain sider reg was SA02 EZT i think that was it, the other is a white curtain sider got a couple straps broke on both sides at the time that is a 03 plate i think
Then there is a 18tonner its a old X reg Volvo blue cab, blue curtain sider, used to be a oldish guy drive it,
Had enough I told VOSA about the cheque about 6weeks ago but seems they are still running well I guess they are whe I did a drive by the yard ? Seems I shell never get whats owed something needs to be done about the law so many get away with it

A trick I`ve used in the past with “dodgy” customers is ;
Your invoice “should” read [i.e] Work Done Blah Blah Blah ; £300.00 + VAT, just slip a “0” on the end, making it £3000.00 + VAT, then state clearly, that you will give a £2700.00 discount for payment received within the agreed payment terms.
If they don`t pay within the agreed period, you have a larger sum to chase, but, at least you have a nice earner, as and when it arrives [via small claims / solicitors letter].
I`ve also played this card, with customers who “can pay”, but are a little skittzy with their book keeping, it wakes them up, shall we say
If he’s still operating I would have thought the local Traffic Commissioner would be interested in this.
I genuinely think you should just go on a little crime spree and target his vehicles or his house…make sure you wear some decent gloves when throwing bricks through his windows
