Problems Problems advise needed

I started my first job as a lorry driver a few weeks back its on self employed basis for a small company with only 3 lorries. I had to do a week in hand then another week before I got paid. Had 2 weeks constant work, got me 1st cheque and it cleared same day I was chuffed :smiley:

Then on the 3rd week I only got 3days work but didnt think nothing of it as the weather was bad on docks etc, then on my 4th week (last week) I only got 2days work and noticed the other lorries were parked up quite abit. Anyway Friday came I was on way back from Northampton the boss incharge of operations (Mr K we wil call him) phones me to say Mr D (the boss with the account in his ame and writes cheques etc) hasn’t come in yet with the cheques do you want me to get him to drop it round tonight ? I go yes no problem.

Friday night no cheque so Saturday I phone again and Mr K goes I will get Mr D to drop it tonight as he was working late last night. It never came, so Monday I phoned Mr K again and he go you still not got paid ? I go no, he goes well heres Mr Ds number so I spent the day phoning Mr D and left a message on answerphone and sent a text at night as well, ever got a answer.

Tuesday (yesterday) came I got hold of Mr D (I thought it was xmas :unamused: ) he answered and goes sorry mate I havent got the money to pay you yet but I am exspecting money in the account tomorrow and I can pay you then. So I left it till today phoned Mr D again and he says the cheque from S********** hasnt cleared and it was for alot of money so it has to be reprocessed :unamused: , I go well how long is that gonna take ? he go it could be today so I go Im gonna get paid today am I ? he goes no you might it depends if it bounces again :unamused: so he says phone back later :unamused:

I have tryed to be very patient but its getting hard now, I mean its only for 3days work come this Friday he gonna owe me for 5days :unamused:
No idea how much longer I gotta be patient for

Start looking for another job NOW! They will mess you about forever if you stay there. When you leave them let this forum know to avoid other drivers getting robbed.

Hope he comes up with the cash but it’s not looking good.

thanks yes Im going to be phoning the agencys up better then nothing with xmas coming up anythings a job, besides I dont see any other firm giving me a chance on Rigids with only a months experience on a 18tonner :unamused: Just had enough at the minute soon as you get up you fall 20steps back :unamused: not what I wanted with xmas on the way

You WILL get ageny work this time of year, so long as you are flexible. Have you a Digi tacho card? This will help immensely.

I seem to remember a similar situation where someone sugested you turn in for work, take the wagon out (probably best to tip the load first) then park it well away and out of sight. Get a lift home then ring and simply say you have a lien on the vehicle 'cos they owe you money. You will only tell them where it and the keys are when you have cash in your hand. They will have to go to it and ring you to find out where the keys are. Leave the keys on the roof maybe. ( A lien is a situation where for example, a garage has repaired your car and won’t release it until you pay the bill ).

Bear in mind that every employee and subbie gambles on whether they will get paid. We all have to trust our employers and generally we get paid. You were one of the unfortunate one’s, that doesn’t make you a mug more a victim of a scumbag, which could happen to any of us.

If he hasn`t, then its unlikely keebs will get paid anytime soon until Mr K does.
This leaves him with a couple of options:
keebs has written into his terms of business, that he will charge interest on any unpaid, late payments (unlikely).
He sells off and factors the unpaid dept to the bank, and gets paid that way (again unlikely).
He get a county court (small claim) judgment for unpiad debt against Mr K & sends in the Baliffs (again unlikely).

I say unlikely, as hes only been driving, & self employed for a very short while, so I`m guessing his naivety will show, and why Mr k has ripped him off

If Mr K has been paid, but is witholding payment, keebs might consider hiding 1 of Mr K`s trucks somewhere, and not telling him where until he gets paid (again unlikely & illegal).

Sorry but that is BS. The company will phone up plod and you will be arrested for theft. The fact they owe you money is irrelevant and the cops won’t give a [zb] because it’s a civil matter between you and the company. Theft of the vehicle isn’t. (And no it won’t make any difference telling them you haven’t stolen it and are merely ‘holding’ it either).

I can’t condone that action, or breaking his legs of course…

Like others have said, maybe hide the truck or keys if that’s legal?

Or, best is to agree to do some work, and just not turn up

In this situation I would play them at their own game. I would not make much of an issue about the non-payment for now, and would seek another shift from them. Then I would go to town with the fuel card and the 5gal drums I’d been collecting. :sunglasses:

No, it doesn’t. Try doing it and see what happens.

In English law, theft was codified into a statutory offence in the Theft Act 1968 which defines it as:

“A person is guilty of theft, if he dishonestly appropriates property belonging to another with the intention of permanently depriving the other of it”. (Section 1)

There’s more to the Theft Act but the OP would have no intention of permanently depriving the owner of the wagon. I doubt plod would want to be involved as long as they knew where the wagon was.

Would the OP be acting “dishonestly”? The mere fact the owners wanted the wagon back may be enough to shake the tree moneywise. Or broken legswise?
Nickin’ diesel would almost certainly be theft.

I had thought about the Diesel idea but then they dont have a fuel card, they leave the diesel cash in the lorries, but with not alot of work for them at present I can’t see me getting offered any even if I wanted it, they have cameras on the gates and sensors in the yard but I knew the code to shut them off and I still have a key but I suspect the codes been changed anyhow :unamused:

I was tempted to phone the company that he says owes him money just to see if this is all bull :unamused: , but I doubt anyone will tell me anything
