I am self employed and I have had this same problem.
Was subbing for a firm and I would invoice them on the 29th of each month. Within 7 days the cheque had landed on my doormat. Worked well for about 4 years and then the time started slipping. 14 days, 30 days, 60 days.
Tried asking his right hand man what was happening and all I would ever get was that the Mr Big was awaiting payment and that the Mr Big hadnt taken a penny in wages for 9 months. More fool him, probably had too much money to start with then.
Anyway, I was getting sick of it so sent my last invoice in with a covering letter. Letter stated that invoice was to be paid within 14 days if not interest would be accrued at 10% each week. Failure to pay within 14 days would also see me taking the company to small claims.
I sent the invoice and disappeared on holiday for 2 weeks. On arrival home there was a cheque.
Know what? He’s also rung me twice since to ask if I will do some more work for him. I laughed.

After my last phone call that Im going to make tomorrow morning, I will go this route while I seek other work thanks for the advise

Sounds like a right tin pot outfit. I shudder to think what they DON’T spend on vehicle maintanence.
The fact they don’t have, or, more likeley, can’t get, a fuel card rings alarm bells.
As s/e HMRC won’t be happy if you only & consistently work for one employer.
If you continue down the s/e route you need to have your terms & conditions printed off & be sure to hand a copy to any employer.
These should include such things as payment terms, amount of interest payable on over due moneys, charge out rates, short notice cancellation charges, minimum hours (per booking) chargeable, employer’s responsibility to provide a legally road worthy vehicle, your right to deviate, at the employer’s expense, to the nearest public weigh bridge if you have reasonable grounds to suspect the vehicle to be over loaded, etc. etc.

phoned today and guess what the cheque that they had bounce is going to clear saturday morning, he states i will be in the office then
If it was me…I would go to the office on Saturday with a couple of very big mates (Just to look very menecing) and say ‘Mornin Boss come for my money’…I reckon he just might pay up.
As a side note this has happend to me before when I was a builder, (£4,000) I wont go into it, but the ‘Only’ thing you can do is take him to the small claims court and he will pay.
However tempting it is to beat the crap out of this scumbag DON’T you will end up in the nick and NO money!!

Tell him you’re gonna take the cheque to the police. You believe he is guilty of committing fraud by false representation. If he is issued the cheque knowing it would bounce this is fraud, a criminal offence. If convicted this may well reflect on his operators licence, good repute etc.
I read the article mentioned. This referred to goods stored for a third party. It is assumed the wagon here is owned by the operator and as such is subject to a lien. This is why I advised to tip the load before “hiding” it. The police, CID, not the traffic cops, may now be the better way to proceed.

been round the house twice and no answer I phoned 8times left messages still no reply, I’m going to have to write him a legal letter does anyone know or have advise on how I can word it ? Is there ay need for me to get a company to deal with this i.e letters etc ?
