why is it likely that poa will be regarded as break and therefore not paid? like i said, 6 months ago you didn’t personally know of any firms that didn’t pay poa, so surely from your own experience it’s likely that it will be paid. but why not just ask to clarify the situation?

I would have thought that as you’re technicaly at work whilst on a “period of availability” you’d have to be paid, as i have said before, I dont use them, but if I wasnt paid whilst on break, then POA would be on quicker than you can say “I’m here to earn a living”

If you drive for 4 hrs and your tip will take 3 hrs surely a 45 followed by 2:15 POA is the best way to go…
Surely a 3hr break would be better - split daily rest 
still needs a 45 … cant have a break attached to a daily rest
Well it seems POA is a waste of time in my current job, I’m paid a very low basic wage then a % of what the truck earns. The hours are about 10/12 a day. On Thursday I had a 6 hour tip, put in on a 45 first then put in on POA for about 5 hours. Drove about 3 hours back to the Yard and the TM looked at my Tacho and said you should have had a Break after your POA under the WTD.
Ummmmm think I’ll just stick it on Break. This Container work is naff.

I’d have probably left it on break in that scenario, that way you could of had a split rest, which might not be of any interest to you And you wouldn’t have to reach over and press the button!!
I’d put it on poa before a 45 minute break was completed if I couldn’t get to the next place in 4.5 and was in a rush or pushed for duty time.

But he’s old, real old and been in the business since 1968, he must know what he’s on about!!!
Think I’ll be going back to Agency work if the wage on Friday is going to be as naff as I think it will.

if its not legal poa as in :your going to be 30 mins drive: would that not be falsification of records if anybody was enforcing itas its not a true representation of hours worked?
but I could show a printout with 2,3,4,28,52 minutes, whatever. Who can prove I wasn’t told “park over there for x minutes?”
You don’t have to be told, you can also use POA based on previous experience.
and you can book 8 or 12 minutes of POA if you want several times a day. Think about a tipper driver, 7 loads a day, every day running out of a quarry. Of course you could also book that time as break but it wouldnt count for anything
