Sorry to hijack this thread but I think this is of similar relevance with regards claiming.
Me and the family went to Nene Valley Railway yesterday, my kids are young 3 year old girl (nearly 4) and a 1 year old boy. Both of them like Thomas the tank engine, who was running that day.
Anyway after a great day out we caught a train back from Peterborough back to the car at the NVR station. As we were getting off the train, I was carrying my 1 year old son and some jumpers/jackets and my daughter was behind me then my wife was behind her with the folded up push chair (the carriage was too narrow to have it up) and he bag.
Anyway as I stepped off I told my daughter to wait while I turned round to help her off as there was at least a 1 foot gap between the step on the carriage and the platform, my wife also told her to wait.
She didn’t wait and fell between the train and the platform. She cut her lip quite badly and has a graze on her chin but otherwise is unharmed. The first thing a family member said was “claim!”
Claim for what exactly my daughter not listening to her parents or her parents failure to ensure that she is safe. I blame no one else for the accident myself and my wife are to blame, it’s our job to protect our children and we failed that day.
Claiming because of the gap between the platform and the train is too big would be foolish.
TBH I think if I/We were to claim it would be successful, as its hapened before and I don’t think there was a first aider on site, but why should we just because we could, the staff/volunteers were great, it’s run by a charity the last thing they need is this, also it will teach me and my wife a lesson and hopefully our daughter might start doing as she is told a little more.
TBH were just thankful our daughter is ok, it could have been MUCH worse.

Once again, thanks for your replies guys, with special thanks to Dozy, (only in name but not nature I am sure),you are right in what you say, thanks for that. Thanks also to Connor for the street view picture it was a great help, although your comments need reviewing, the same for a lot of the other “barrack room lawyers”. I have been on the road a long time, doing different things all over this great country and a lot of europe, met a lot of good people while doing so, all I asked for was a little bit of assistance, not the rights and wrongs of suing companies. I am not a careless person, but this time I decided to do something about it as I felt that although I am a “Bluenose” I feel that blue painted slip/trip/fall hazards are not 100% correct. Yellow /Amber/Orange and Black Stripes are Hazard Markings, if you are not sure about that, I suggest you walk round the back of your trucks sometime and check them out. End of Rant.
no wonder insurance is so high. if you was climbing out the cab and holding the cab door pole supports would you have fallen over? im guessing no.
I agree with dazaster, If you got out of the vehicle backwards using the door poles supports you would have had no reason to fall over the blue wall.
Unless you was parked very close to the wall opened the door then jumped out.
maybe you mistook the truckstop for a circus, clown comes into mind.

F F S , the poor blokes had an accident , asks for a bit of help and gets the riot act thrown at him . we could all have an accident some time or another . if he suceeds good luck to him , if not so be it . who knows , could have been slippery due to spillage ■■? all i hope is , that none of you insurance freaks trip over tomorrow !
I’m sorry you broke your hand. However, I’m assuming it was in daylight, so perhaps you should have been a bit more careful in what your doing. When I was younger I fell off my bike loads of times, including going over the handlebars ( ), I even knocked myself out once. A nice old lady looked after me and gave me a can of pop until my mum could pick me up
The point is no one was sued. It was all my own fault really. Its about time people started to take responsibility for their own actions.
Health and safety used to be about reducing genuine risks with the provision of adequate equipment and assessing risks. Now it’s about doing anything to avoid being sued. I’m glad the copper let the petrol station claim go, it was stupid really. All around us are trip hazards, kerbs along many thousands of miles of roads, steps, stairs, bumpy off road tracks etc etc. it’s just not practical for everywhere to have warning signs up.
With respect, if you had have been a bit more careful, you would have been ok.

Did you manage not to walk into the pumps or office doors ? And be careful where you’ve parked your lorry in case you walk into it.

Claiming because the warning wasp stripes were the wrong colour is exactly the reason why we have to sit in shark cages, have keys taken off us, wear hard hats when there’s no danger of anything falling on you and have pointless safety inductions. Everytime someone acts stupid they ruin things for someone else down the line.

I often wonder if the reason why young drivers have proportionately so many accidents is that they’ve experienced a virtually risk-free childhood (that and the fact that by the time they get behind the wheel of a car they’ve already done about a million miles of Grand Theft Auto)?
I remember a work colleague being horrified when I mentioned that our house was heated by open fires.
"You’ve got a small child, what happens if he puts his hand near the fire and burns himself?’ he said to me.
“It’s a mistake he’ll only make once,” I replied.
It’s a fact that little children need some exposure to risk, and to hurt themselves once or twice, or ‘danger’ is just an abstract concept for them.

Exactly and as petrol stations actualy make very little profit on fuel its only a penny or two a litre someone has to pay.
