Personal Accident At Alconbury T/S Help Required

Not Sure if this is the right part of the forum but hopefully someone will point me in the right direction.
On the 12th August last I pulled into the Alconbury Fuelstop as the previous driver didn’t fuel up when he left the truck, and as I tried to refuel I fell over the Blue painted wall at the end of the fuel pumps as I climbed down from the cab, breaking bones in my right hand at the knuckle joint, and as a result unable to drive for a couple of months. What I need from someone is a couple of photo’s of the fuel islands especially between diesel pump eight and ad-blue pump fifteen. If anyone can help a fellow trucky it would be really appreciated. Including the blue painted end of the island furthest from the A14 (Cab End)

Are you suing them?

Right direction would seem to be ‘Specsavers’.

Is the wall painted blue so that they can’t be sued if someone falls over it :bulb:

Have you tried google earth ,or streetview ,if you have an i phone you can take a snap shot , good luck! :unamused:

:stuck_out_tongue:

Just checked the Google map it doesn’t show any drivers rolling about on the ground in agony or a fleet of ambulances waiting for punters does show a distinctive BLUE
painted wall seemingly between every pump.Must be BLUE so you don’t miss falling over it,considerate.

Op, whilst I sympathise totally with the pain you have suffered and with the inevitable loss of earnings you’ll incur I do question where you are hoping to go with this once you get your photographs.

I think that you’ll find that in order for the company to be proved negligent you will struggle, them pumps have been that way for many many years and have proved to be no hazard whatsoever for countless others using them. If for example there was a large amount of spilt fuel on the floor which you could prove had been brought to their attention and they’d failed to clean it up then imo you’d rightly have just cause to slap a claim in. The simple fact of the matter is that YOU fell over so it was YOU that was negligent and to attempt to sue the third party is just plain wrong.

How about if you were driving your car, took a corner too fast and crashed? Would you sue the manufacturer for making their cars too fast? If anything maybe you should consider suing the previous driver for his negligence in failing to fill the vehicle up before handing it over to you!

Thanks for all of your replies guys, but the decision to claim or sue is for me and my advisor’s to make. It may well be that I don’t have a case, but all I wanted was If possible, some photo’s of the area so that a decision could be made. I am unable to drive at the moment so I cannot go up there myself, also thanks for the Google Earth clue, that may help, and my specs funnily enough are from Specsavers which thankfully were not broken in my accident.

That’s the trouble with this country now.
Too much claim culture.
If you fall over whilst sober, god help you when your drunk.

Too right Greggy…

Another pillock blaming others for his own stupidity and trying to sue for money that the rest of us end up paying for through higher insurance premiums. Personally I’d be so embarrassed at my own idiocy I’d have kept it to myself.

As they’re great big whacking almost THREE FEET HIGH pyramids almost half the height of the fuel pumps and painted BRIGHT BLUE I have no idea how Jimmy expects a claim to succeed other than by outright lying.

See for yourselves - you can hardly miss them: goo.gl/maps/xteTc

How’s about suing yourself for your own stupidity. You’ll see yourself in court, and that way you can pay yourself the money, thus everyone’s a winner

I remember my daughter passed her test and with putting me on her insurance we got it for £350, when it came to renewing it the new premium was nearly double that £700 ,even though she was a year older,no accidents, year no- claims etc,I rang them up and they said because of every bit of ■■■■■■■■ you could come up with,I then went on line and tried did all those sites,go-compare,money supermarket etc,we got a decent company for about the £350, so I rang up her company and said my girl wouldn’t be renewing as we’d got her inscheaper elsewhere, girl asked how much was our new insurance :unamused: ,she then proceeded to chec k our quote with them and surprise, surprise it came in cheaper than the new company :unamused: :unamused: :smiling_imp: :smiling_imp: ,I told her to get stuffed, shed tried to rip my girl off and no way were they getting a penny out of her.
So do premiums go up because of claims,do they zb,they go up because we’ve no choice but to have insurance, they can do what they like, the only time there interested in reducing them if you tell them I’m off elsewhere. :unamused: :unamused: :smiling_imp:
So don’t have a 2nd thought about sueing them, they couldn’t give a ■■■■ about trying to rob some 17 yr old girl of weeks and weeks of her hard earned money,if here dad hadn’t stepped in she’d of probably paid the £700, and these say premiums go up because of claims, they go up because there robbing zb.
Last year I had 10,000 for mrs, girls accident,£4,000 the year before, not a second thought from me,
Insurance companies have no morales so neither have I.
Hope you screwthem for every penny you can, best of luck

I am sorry for your injury, but have to agree it was an accident on your part.I myself and many others I suppose have fallen and injured ourselves.
Insurance is at a high price that we all have to pay I am sure you would agree with that?
imagine if we all claimed for something every time something happened, Just my opinion.

Sorry for your accident but as others have said I doubt you’d have probable cause in front of jury They are clearly marked up. Were the cones their before your accident looking at Google map front of pumps.

OP,

Just remember that woman copper in Norfolk that was attempting to sue a petrol station for her carelessness.

She has now dropped the case.

You , its not the insurance companies that pay its the end user who gives them the money in the first place.

All premiums go up in some degree every year to pay for all the claims, by phoning them you got a better deal.

Once again, thanks for your replies guys, with special thanks to Dozy, (only in name but not nature I am sure),you are right in what you say, thanks for that. Thanks also to Connor for the street view picture it was a great help, although your comments need reviewing, the same for a lot of the other “barrack room lawyers”. I have been on the road a long time, doing different things all over this great country and a lot of europe, met a lot of good people while doing so, all I asked for was a little bit of assistance, not the rights and wrongs of suing companies. I am not a careless person, but this time I decided to do something about it as I felt that although I am a “Bluenose” I feel that blue painted slip/trip/fall hazards are not 100% correct. Yellow /Amber/Orange and Black Stripes are Hazard Markings, if you are not sure about that, I suggest you walk round the back of your trucks sometime and check them out. End of Rant.

This is typical of the reason why we are bogged down in health and safety.Because folk are always trying to claim for such incidents like this, where it would appear the only person to blame is the driver.
