Do agencies no longer pay overtime I thought overtime was payable for hours worked over those 40 hours. So why are agencies only paying the same hourly rate for all hours worked after taking out your 45 minutes break, anybody else not getting paid overtime?
They don’t pay overtime just like they never give a pay rise.

I don’t know where you get the idea that o/t is paid after 40 hrs, that went out with the ark. it all depends on your contract of employment when you get paid overtime. if you are salaried you might not get any at all, where as some might get it after 45 or 50 less break or what ever, I am lucky if I work sat or sunday I get o/t but Monday Friday I am salaried so if I finish early I gain if I don’t I don’t lose

Previous generations fought for, and achieved, time and half over 40 hours, this took care of the bottom line on your payslip, now it’s this time and a pound after 50 hours ■■■■■■■■, which is why we have to work excessive hours just to keep up with the cost of living . I know that there has been a recession, but was it, and is it, as bad as we are led to believe, employers have used this as an excuse to keep on paying crap wages, but can still afford top range motors, subsidised by said crap wages, what the hell happened, everything that was fought for has been lost and we are back to being kept in our place.

Yes so it seems it went out with the Ark a lot has changed in the past 12 years from being out of this country. it’s just I couldn’t believe that I was paid the same hourly rate for all hours worked - even more so when I asked about this - I was informed that the agency are charging £17.15 + 20% VAT and only paying the drivers £9.50ph
I work for an agency that is very good, never advertises and only works from word off mouth. drivers have to be recommended to get on and he only sets enough drivers for the amount off work he has… and I get overtime after 40 hours.
I get o/t after 8, o/t all day Saturday and double time Sunday. New agency weren’t happy when they poached the work from the old family run one, but we all threatened to walk and they rescinded.

Flat rate for me, paid for what I work, 30 or 60 hours, nights or days, same hourly rate!

I find it varies from client to client, but the agency won’t tell me if I don’t ask.
I suppose from the clients point of view time + half is open to abuse from drivers taking their time.
I see less time + half on class 1 work than class 2 with hiab, but then there’s more hours on class 1, many of which can be your sat around waiting.

Well said mate, and it still continues today, some can’t see as far as their nose ends however much you try and point things out to them , you know the ones… those that as long as they are seen to be driving a Megaspacesupergiggatoplineglobetrottinghiliner with Kelsas hellas and illuminated cab board, it doesnt matter to them if they get paid next to ■■■■ all for driving it for 90 hours a fortnight, not just that but it spoils the chances of the more serious drivers getting a pay rise as employers love these guys… and laugh their knobs off at them at the same time
As much as I have enjoyed driving similar spec motors in the past (ok maybe not with the illuminated name board ) I have been lucky enough to drive them on a decent wage, my priority has always been cash rather than flash.

We asked for less money and more hours, we asked for more regulation and less freedom, we asked to pay to park or sleep badly in a layby.

Fair comment mate, but you can’t argue that SOME driver’s attitudes, reasons, and approach towards the job,examples of which I illustrated in the points I mentioned previously, have’nt exactly helped the situation, so ok maybe not all, but some blame can be down to drivers in my opinion.

No, I’m not old enough. From the little I know about logbooks though I’d say paper tachos were nearly as easy to manipulate. I enjoyed it at the time, watching some Trading Standards jobsworth trying to make head or tail of what I’d been doing and how I’d done it. They could have saved themselves a lot of time and trouble if they’d just accepted my impeccable cards at face value, instead of trying to catch me out or trip me up.
I actually had some trainee VOSA card-botherer ask me what time I started work and what route I’d taken to arrive at the weighbridge his colleague had pulled me into recently. I pointed out that he could tell me what time I started my duty as I had made a manual entry to show it. His other colleague (who had a fantastic name) was busy analysing my card in the van he had just got out of. I explained the route I had taken and that the speed of the vehicle would correspond to the legal limit for that weight of vehicle for the roads I had used.
Not much change in approach from either side there, then.
What happened over there ?
When I left it was law that every employee, no matter what job he or she had must get overtime after 8 jours each day, not 40 hours per week, it was based on per day, if you only worked one day per week and did 12 hours you got 4 of them at overtime rate.
You must have all gone soft.
If an agency doesn’t pay it, don’t work overtime for them, they will soon give in and pay it if you refuse to work over 40 hours.
