Overnight Subsistence Rates gone UP!

Hi All,

The Overnight Subsistence Rates increased on the 1st january 2012 to :

Subsistence Allowance for drivers without sleeper cabs £33.85

Subsistence Allowence for drivers with sleeper cabs £25.39

And this is from HMRC…

hope this helps.

We don’t get that much but then again we get all our parking fees back.

We get £26.00 have done for a while now and parking paid so can,t complain really.

You should do though , these rates are set by HMRC… :unamused:

Thats fair play…

Not done a night out for nearly 6 months but I think it’s about £ 19.00.

I was getting £27.50 night-out money in 1994.

Bloody hell that would have bumped up the pay packet.

Especially as I used to be away 30/31 days a month.

Although HMRC do set a guideline amount, it is possible to negotiate a different rate with individual tax offices, which is what Kepstowe did.

Means nothing other than that is what they can pay you without you being taxed on it. If you get paid any more then it gets taxed however that is not the rate thy have to pay you.

actualy not quite correct, it is the amount that HMRC will allow you to pay without submitting reciepts.

Any out of pocket expenses are reimbursed without being taxed with or without reciepts

You can in fact spend a lot more if you wish ( spend the Night in the Dorchester @ £230 nothing stopping any driver doing so) but anything over the limit must be accounted with receipts.

there is somewhere a breakdown of how its calculated

x amount for bedding laundry
x amount for personal laundry (clothing)
x amount for food
x amount for hygeine
x amount for digs ( hence the reduction for those with sleeper cabs)
etc etc

It is all based upon the drivers own personal welfare when away from home

what it specificaly does not cover is parking for the truck - something that has recently been investigated and will be in an upccoming isue of CM

And Harry is right, local tax offices can set the limits that reciepts are needed- they can also do it on a firm by firm basis or even for individuals the upper limit set by HMRC is only guidline advice.

It should be noted despite popular myth there is actually no legislation that says any employer has to pay any night out allowance at all… It is expected that employers will reimburse employee’s out of pocket expenses ( which is what HMRC class night out money as) but unless it is written into a contract of employment there is no legislation that says they have to do so.

Yes, basically, it is paid as a tax-free allowance because it costs more to live away than it does at home. Beans on toast at home costs 20p, beans on toast at Moto costs a fiver. Washing clothes at home costs £1, washing them in a launderette costs £10. It costs more to make a phone call from a mobile phone than a landline.

Etc etc etc.

If the way the system worked was that we submitted every receipt for every Ginster’s pasty that we purchased, then the Revenue would be so flooded with receipts and paperwork that they wouldn’t be able to cope. So they set a figure which they consider to be a reasonable amount for the cost of three meals a day eaten out, laundry etc.

There is no obligation to spend any of this on any of the things it is allowed for, and like many I self cater and use the money to top up my otherwise inadequate wages.

It is NOT to cover the cost of parking the truck, and if your boss tells you that it is then you should tell him to go do one.

Its quite simple if parking wasnt paid i’d just stay in lay bys and pay a quid to use the shower at services.

Parking is and always has been a separate issue. Subsistence is for the drivers, to subsidise them for the extra outlay. Bedding Laundry. Extra Meals etc

Parking is a legitimate business expense for the operator, just like fuel, wages, tacho charts and tyres.

I had a sniff at Fords about 10 years ago. £78 night out then!

spoke to hmrc , they told me that if employers wont pay the £5-39p extra , thats if your getting £20-00 a night , you can claim the £5-39p back from them …and back dated

Are you sure they didn’t mean you can claim the tax paid on the £5.39 back? Something tells me HMRC are not about to make up the shortfall on what your employer isn’t paying you for night out money.

It is NOT to cover the cost of parking the truck, and if your boss tells you that it is then you should tell him to go do one.

If, as posted further above, there is no obligation on the boss to pay you ANY subsistence, he could tell you that the money he pays for nights out includes parking costs.

Not a full time tramper, but I do one or two nights out a week. The company does not have to pay for parking on top of the subsistence money. Doesn’t surprise me that MSA charge at or above the current subsistence allowance.

I always find an off trunk road layby to kip in to benefit from the night out money.

Layby - free (and no one demands you turn your fridge off)
Wetwipes - £2.00 will last a while
Gas stove and cartridge £20 initial outlay and cartridge only just running out after a year. Cooks a nice steak or heats up a microwave meal or tin in minutes.
Have to use mobile WiFi instead of free WiFi - £1.00 a night (O2 wont let me change tariff for a year!)
Showers - free at some places otherwise shower at head office or go a bit grimy for a day.

Now, if you wore a suit and tie and were paid to tell lies (sales/management), you would get a free company car and petrol, accomodation in at least a travelodge, evening meal paid for, possibly beer paid for. But cos your skills only extend as far as turning a steering wheel you are classed as unskilled and get treated as such.
