Please do let us know the outcome. It probably won’t reach the court like said and I can’t see it taking VOSA long to backpeddle when they realise the implication of an unfavourable precedent being set. Hoist by their own petard methinks.
well i was informed today by the now retired driver that he recieved a letter via the company solicitor that he WONT be having his day in court for being 1 minute over his 4.5 hours driving and 4 mins over a ten hour driving as they have cancelled the fpn’s and that he would be hearing no more about it. boss says it was one of the best £300 solicitors fee he ever paid

Well, after having no infringements for nearly 12 years, I got my second one in three weeks today; Going 20 mins over 15 hours, a similar reason as before. Sent out on a double manned run except I had an agency mate with no license, experience of taillifts, curtainsiders etc.

So far in my experience, I’ve been over the 15hr (not enough rest) over my 4.5hr, over the 6hr, left card in overnight on other work, left card in over weekend on other work, over my 9hr, over my 10hr and I got pulled off a cop who pointed all this out and no further outcome (I was pulled due to some yellow missing off the long vehicle markers on the back of a skelly).
I’ve never paid a fine for any of them and have no intention of ever paying a fine due to work. If I run over my hours, there will be a good reason, and if they want to take it further, I’d always be happy to have a visit to court.
a very good friend of mine has recently been done in south London for 4h 32 and 4h 39, he is now 120 pounds lighter because of it vosa are taking a really hard stance against these so called minor infrigments and they are tolerating it at zero percentage over run your time at you own risk but be warned you will get fined

So, according to that, if you’re 1 min from base and just about to turn to 4.5hrs driving, you’ve got to stop, have a 45 minute break, then drive the extra minute.
Bollox, you just drive to base.
There’s not a chance on this earth that it’s ever going to be that bad unless you’re over-running everyday.
Drivers are only doing what they are asked/told to do. Talk about shoot the messenger. Now if only they introduced these limits to all commercial vehicles like delivery vans etc. Maybe then certain companies would stop taking the p*ss out of the drivers.
I stopped 2 minuets away from an asda depot in Bristol for a 45 min break before while on agency working for them because I knew that by the time I got through the gate I would have been over my drive time , they were fine with it when I told them and would rather I did that than break the law , did expect a different response from them but in the end of the day it’s my licence .

Good result but, only problem is, VOSA will hold a grudge over this, his boss or ex boss, will probably notice an increase in tugs by them in the future, we’ve had situations were VOSA have clearly been wrong but its not worth the hassle to cross them for a £60 penalty or a gv9 until a “problem” is sorted!
