over my time twice in 2 days, 1st yesterday on a 15 by 12 mins, because I had to reverse out a lane for 1/4 mile after someone shut a gate that was normally open and I couldn’t park in front of it, so had to back out to the main road and park up other wise I would of been about 14 hrs 58 mins, did a printout and wrote my explanation on back and then tonight by 6 mins on a 13 hrs after getting held up on the M25 again printout and explanation,
do you think I will have to bend over if I get stopped by mr vosa or will I get away with it with the print outs, having come off of analogue tacho’s and gone on to digi its a real pain never messed up like that before

I did 15hrs 30mins on Tuesday night, getting back to the mill. I wrote o tacho that I got held up near to base but the truck had a sleeper cab. First time I’ve ever gone over 15 hours, a heinous crime or not?

I’d have been sorely tempted to call his bluff and tell him to bring it on. Firstly I wouldn’t imagine that it would ever reach court, and secondly can you imagine the response of a cantankerous old judge who is having his time wasted over the persecution of a guy who’d worked one minute too many! It would certainly set an unwelcome (for VOSA) precedent.
That’s gotta be BS, that Liverpool vosa did him for 4 mins and 1 min over, jeez ill be off to Abu Ghraib if they ever stop me & that’s without intentionally taking the mickey.
just checking the vosa guild lines, it says they should give a 15 min tolerance before issuing a fixed penalty notice, unless the driver continually uses the 15 mins, then the fpn should be issued so it looks like I am safe for now

this happend 2 weeks ago and yes he is taking it too court, company soliciter recons it wont even reach the court steps, so vosa was informed that it will challenged in court so watch this space

Please do let us know the outcome. It probably won’t reach the court like said and I can’t see it taking VOSA long to backpeddle when they realise the implication of an unfavourable precedent being set. Hoist by their own petard methinks.
all fines for driving over hours should allways go to the firm to pay because
a) they are the ones allways pushing the job to the limit of the law with their “can you just do this”
b) if they where the ones paying they would make sure you did’nt go over.

most wouldnt but some would, the guy that got done couldnt be a nicer fella if he tried, old school ( he’s 65 yrs old ) and retires a week on friday. this guy has a 45 year blemish free driving record and 36 years of them is with the same firm he is retiring from.
