Notice period for a traffic offence?

Evening all
What is the notice period for the traffic period of driving without due care? I think its 30 days?? Ive just recieved one after 90 days after i got tugged?..
And yes i did do it and put my hands up to the offence.

Why doesn’t this surprise me?

bee chris, the man who posted videos on YouTube of himself ramming cars off the road and deliberately causing accidents/near misses, is being done for driving without due care and attention? :open_mouth:

As I understand it, IF you were not stopped by the police, or spoken to, at the time of the offence then you have to be notified by post within 14 calendar days with a ‘Notice of intended prosecution’ (NIP), then they have a further to 6 months to summons you to court.

IF you were stopped by the police at the time of the offence and told that you would be reported (verbal NIP), they then have up to 6 months to summons you to court. (No postal NIP necessary)

Note that the 14 day rule applies to the first NIP to the registered keeper not subsequent ones.

the 14 day rule only applies to minor traffic offences. ie: speeding.
when you are questioned you will be cautioned, the caution is your “notice”. the crown prosecution service have 6 months (180 days) from the date of the offence to issue court proceedings. in other words they can have been known to issue on the 179th day

I had forgotten the user name of the guy that posted them, until now. Basically, they were all dashcam vids allegedly of various other motorist’s dangerous driving errors but, on viewing, it became apparent the whole thing was like irony 101 where he was actually either the cause or could have easily prevented most of the scenarios.

When I first read the thread it seemed like it was a classic Trucknet dog pack attack but after viewing the vids the driving standard was exceptionally bad and it would be hard to put up a defence for it really.

One word karma.

They “recommended” the driving course also, btw, but haven’t heard anything…

(Maxing out circumstances and green lights but plod claimed their speed to catch me up from 2 miles away was my speed by their camera)

You should now be in the clear as the prosecution is ‘Time barred’ based on what you said…The exception to this would be if you have changed address during that time and the summons/paperwork, etc, was sent to a different address for whatever reason, in this case the court hearing would proceed in your absence and any fine/ban would be in effect.

It might be an idea to contact dvla and confirm that your licence hasnt been revoked, or points added in your absence. (it has been known to happen)

Be aware also, that any fines imposed will still be outstanding and will eventually catch up with you… :confused:

The posting of evidence on YouTube of your complete and utter incompetence behind the wheel might be in the past… but judging by the fact you’re currently awaiting prosecution for driving without due care and attention, you’re clearly still driving around like a [zb].

I’ve just re-read the original thread and as predicted, you didn’t listen to any of the advice given.
Is this prosecution anything to do with the crash you posted? The dates aren’t too far out. If it’s not, then it’s evident you will never learn.
